"pursuant'to the provisions of 37-60-119, Colorado Revised <br />Statutes 1973, as'amended, the Colorado Water Conservation Board is <br />authorized to construct certain water projectS for the benefit of the <br />people of the State of Colorado; and <br /> <br />WHEREAS, the Town of Hudson has made application to the Colorado <br />Water Conservation Board for the construction of a water project for <br />the purpose of improving its municipal water supply; and <br /> <br />WHEREAS, the Contractor is a professional engineering firm within <br />the State of Colorado and has previously done considerable water-related <br />work for the Town of Hudson and various other municipalities in Colorado; <br /> <br />NOW THEREFORE, it is hereby agreed that <br /> <br />1. The Contractor agrees to prepare a feasibility report directed <br />to the problem of improving the municipal water of the Town of Hudson <br />in accordance with a proposal for project feasibility report prepared <br />by the Contractor and approved by the Colorado Water Conservation <br />Board, received March 25, 1977, which proposal is attached hereto as <br />Appendix A and made a part of this contract. <br /> <br />2. Fifteen (15) copies of the report called for in this contract <br />shall be furnished to the State not later than July 30, 1977, unless <br />such time is extended by mutual agreement of the parties hereto. <br /> <br />3. As compensation for the services of the Contractor, the State <br />agrees to pay the contractor the sum of Three Thousand Nine Hundred <br />Twenty-Five Dollars ($3,925) in the manner following: <br /> <br />a. Sixty percent (60%), to wit, Two Thousand Three Hundred Fifty- <br />five Dollars ($2,355) of the total amount due in two (2) monthly <br />installments of One Thousand One Hundred Seventy-Seven Dollars <br />and Fifty Cents ($1,177.50) each, commencing on May 30, 1977. <br /> <br />b. The remaining forty percent (40%), to wit, One Thousand Five <br />Hundred Seventy Dollars ($1,570) within thirty (30) days following <br />receipt and acceptance of the written report specified in para- <br />graph 2 of this contract. <br /> <br />4. This contract is personal in nature and assignment of <br />performance by the ContrRctor to another is prohibited unless prior <br />approval in writing is granted by the State. <br /> <br />5. The Contractor is an independent Contractor and as such is <br />not entitled to any benefits of the State personnel system. <br /> <br />6. It is understood and agreed that the total cost of said fea- <br />sibility report is $7,850, of which one-half, to wit, $3,925, shall be <br />paid by the town of Hudson; and in no event shall the State be liable <br />for such portion or any part thereof which is to be paid by the town of <br />Hudson, the State's liability under this contract being limited to a <br />total of $3,925 as set forth in paragraph 3 of this contract. <br /> <br />Page I or -3.... pag{'s <br />-(See instructions on reverse of la.~t page.) <br />
