1. You will fully implement the proposedPMJM mitigation plans as
outlined in the Biological Opinion dated December 27, 2001.

2. Impacts to potential PMJMhabitat will be offset through the
mitigation of 4.67 acres with the action area. Specific locations and
acreage (as specified in the BA) may be found in Table 1 of the
Biological Opinion. All mitigation lands will be restored, created, or
enhanced as either grassland or shrub-grass communities.

3. As part of the created habitat component of ndtigation work, a
60 foot wide travel corridor incorporating high-quality PMJM habitat
. will be constructed along the western edge of Monument Lake (see Table 1..
in the Biologieal Opinion), A fence will be constructed along the
corridor (with signs that identify it as a sensitive wildlife area) to
deter pedestrians using the adjacent trail from damaging the habitat;
this fence will remain in perpetuity. The'FWS will be notifies of any
habitat degradation due to human impacts. You sahlI strive to maintain
Monument Lake'S water level such that wetland hydrology of the area can
be preserved. ..

4. To facilitate potential movement of PMJM along the Monument
Creek waterway during the 2002 growing season, the applicant will plant
the outermOst 2S feet of the southern staging area (area 4b as
demarcated in the BA) with a shrub-grass seed mix by May 15. 2002. The.
remainder of the. staging area.will be replanted in.June.

5. All vegetation uaedin reseeding and replanting will be native.
to Colorado. A weed control prOgram, utilizing chemical and/or
mechanical means, .will be implemented on all created, restored, and
enhanced habitat until revegetation success criteria are met.

6. Construction activities will take place, .1;0 the maximum extent
practicable, between October 31 and May 31. Because PM~M fs more active
at night, during its active season (June 1 through August 31) work will
be performed between the hours of 6 a.m. and 6 p.m.

7. Construction on the embankment will not extend beyond ite
current (December 2000) footprint, except for approximately a feet as
