<br />. <br /> <br />. <br /> <br />with this paragraph and provide copies to the District before said subcontractor <br />or consultant commences work. <br /> <br />13. Insurance. <br /> <br />A. The Contractor shall purchase ,md maintain insurance which will <br />protect it, the District, and the Sponsoring Agencies from claims set forth <br />below which may arise out of or result from the Contractor's operations <br />under the Contract, whether such operations be by itself or by any <br />subcontractor or by anyone directly or indirectly employed by any of <br />them, or by anyone for whose acts any of them may be liable: <br /> <br />1) Claims under workers' or workmens' compensation, <br />disability benefIt and other similar employee benefit acts; <br /> <br />2) Claims for damages because of bodily injury, occupational <br />sickness or disease, or d.eath of employee; <br /> <br />3) Claims for damages because of bodily injury, sickness or <br />disease, or death of any person other than his employees; <br /> <br />4) Claims for damages of the type usually insured by usual <br />personal injury liability coverage which are sustained (a) <br />by any person as a result of an act or omission directly or <br />indirectly related to the employment of such person by the <br />Contractor, or (b) by any other person; <br /> <br />5) Claims for damages because of injury to or destruction of <br />tangible property, induding loss of use resulting <br />therefrom; and <br /> <br />6) Claims for damages because of bodily injury or death of <br />any person or property damage arising out of the <br />ownership, maintenance or use of any motor vehicle or <br />machine. <br /> <br />B. The District will not require the Contractor to acquire or maintain <br />errors and omissions insurance to conduct the study. The Contractor <br />shall be liable only for damages directly attributable to the Contractor's <br />negligence in carrying out its duties as specified in this Agreement. To <br />the extent that Contractor's employees are acting within the scope of <br />their authority under this contract, such liability shall extend only to <br />Hydrosphere Resource Consultants, Inc. as a corporate entity and not to <br /> <br />6 <br />
