<br />\ <br /> <br />. <br /> <br />. <br /> <br />to receive any of the benefits of the personnel system, or have any claim <br />therefor whatsoever. <br /> <br />9. Warranties. The Contractor represents that the services to be furnished <br />under this contract will be in accordance with generally accepted professional <br />practices. Any estimates given by Contractor for cost of equipment, <br />construction, ownership or operation of facilities shall be the Contractor's <br />opinion based upon its professional judgment and experience. Contractor <br />warrants that it can fully perform the services required by this agreement in the <br />required time and within the terms of compensation set forth herein. The <br />Contractor makes no other representation or warranty, express or implied. <br /> <br />10. Cham!:es in Scope of Services. Changes to Attachment "2", Scope of <br />Services, may be made at any time during the duration of this contract without <br />processing an executed amendment to this contract. Such changes shall be <br />authorized in writing by the Contractor and the District following consultation <br />with the Sponsors Committee, in advance of implementation of such changes. <br /> <br />11. Contractor's Principal and Proiect Manaszer. Charles M. Brendecke shall <br />be the Contractor's Principal in Charge and Project Manager for this contract. <br />As such, he shall be responsible for taking all actions required to effect this <br />contract on behalf of the Contractor. The Contractor will not assign a different <br />Principal in Charge or a different Project Manager for this contract without <br />advance written approval by the District, following consultation with the <br />Sponsors Committee. <br /> <br />12. Subcontractors. Pursuant to the Scope of Services, the Contractor has <br />identified specific sub-consultants to be utilized in completing the product. <br />Other than the sub-consultants, the Contractor may, after written approval of <br />the District, following consultation with the Sponsors Committee, obtain the <br />services of other subcontractors and consultants as the Contractor deems <br />necessary and appropriate in the performance of this contract. All payments <br />due such subcontractors and consultants shall be the sole responsibility of the <br />Contractor. Such subcontractors and consultants shall have no claim, lien or <br />cause of action whatsoever against the District or any of the Sponsoring <br />Agencies because of the Contractor's failure to make payments to any such <br />subcontractors or consultants for services rendered and expenses or other <br />liabilities incurred by such subcontractors or consultants. Contractor shall <br />obtain a lien waiver from each such subcontractor or consultant in conformity <br /> <br />5 <br />
