WIIEREAS. ') pursuarlt to the proviSions of 37-60-119, Colorado Revised
StatutOs 1973, os a~cn~Qd, the State is authorized to cOnstruct certain
water projects for the benefit ot the people of the State; and

WH~REAS, the Contractor is a city in the state of Colorado and
wishes to complete construction of its water supply systenl, herein-
after called the project, for the citizens of the City of Rifle in
Garfield County, Colorado, at an estimated cost of Three Hundred
'rhousarld Dollars ($300,OOO); and

WH~REAS, a feasibility investigation of said project waS conducted
and it was found that such a project is economically feasible; and

WIlb'REAS, the State has agt"eed to construct said project and to
sell tne same to the Contractor upon mutually agreeable terms and
conditions, subject to the approval of appropriations for tnat
purpose by tho Colorado General Ass~mbly and the Governor o( the
State c[ Colorado; and

WllgREAS, pursuant to Senate Bill No. 67, pifty-Second G.neral
AssemblY of the State of Colorado, duly enacted by the Colo~ado
General Assembly and approved by the Governor of the State of
ColoradO, there was appropriated to the Colorado Water Cons~rvation
Ooard, the sum of Three Hundred Thousand Dolla:rs ($300,000) for
construction of the Rifle PrQject;

NOW TIIEREFORE, in consideration of the mutual and depen~ent
covenants Ilerein contained, it is agreed by the parties her,to as
follows:

A. The Contractor agrees that it will:

1. Cause the construction of $aid project to be completed within
two (2) years of the date of this contract in tlccordance with the
project plans and specifications ~nd any necesGary modification thereof
approved by the State. No payments will be made under this contract
until the project plans and specifications are approved by the State.
The above-mentioned time may be e~tended by the State if such time is
insufficient because of acts of GOd or other acts or circumstances
beYond the control of the Contractor.

2. Convey Or cause title to b~ conveyed by deed or other proper
conveyance to the Colorado Water Conservation goard, Department of
N2tural Resources, state of COlorado, the following portions of the
propos,d project facilities:

a. A 24" Raw Water Transmission Line consisting of approximately
3800 line~l feet of ductile iron pipe beginning approximately
at the north right-of-~ay of Colorado Highway 6 and continUing
north generally adjace~t to the eaSG line of the NW~ NW~ of
Section 15 and the east line of the W~ SW~ of Section 10,
all in Township 6 South, Range 93 West of the 6th Principal
Meridian, and ending at the new Graham Mesa Water Treatment
Plant.
