An alternative to be included in this study is the <br />potential transfer of storage rights in existing <br />offstream reservoirs (such as Empire, Jackson and <br />Riverside) to the Hardin reservoir. The Contractor <br />will investigate possible uses for these offstream <br />reservoirs in the event that the storage rights were to <br />be transferred to the Hardin site. <br /> <br />Task 8 - Water Ri~hts Analyses <br /> <br />The water rights analyses will consider both existing <br />water rights impacting the Hardin reservoir site as well as any <br />conditional decrees whiCh may have an effect upon reservoir <br />storage and operations. The analysis will establish the amount <br />of new water which may be developed by the reservoir under <br />several assumptions regarding the status and tranferability of <br />conditional decrees, the use of a 1982 decree and return flows <br />from transmountain diversions. <br /> <br />All water rights work will be done in consultation with the <br />CWCB. The work for this task will include the following: <br /> <br />a. Conditional decrees which may affect the storage of <br />water in Hardin reservoir will be investigated and a <br />range of reasonable assumptions will be developed <br />regarding the future status of these decrees. <br /> <br />b. The status of the Weld county Reservoir (Hardin Dam) <br />conditional decree will be investigated to address the <br />question of due diligence on this filing. <br /> <br />c. For reservoir routing and yield studies, the following <br />assumed water rights conditions will be studied as a <br />minimum: (1) A 1982 decree for the Hardin Dam site, <br />(2) A decree equivalent to the Narrows Dam conditional <br />decrees, (3) Transfer of decreed storage rights in <br />existing offstream reservoirs downstream of the Hardin , <br />Dam site to the Hardin Dam site, (4) Transfer of other <br />significant conditional decrees to the Hardin Dam site <br />or any combination of the items (1) through (3) above <br />with other significant conditional decrees as appears <br />to be feasibile. It is anticipated that no more than <br />six possible water rights alternatives will be studied. <br /> <br />d. The analyses will include an assessment of the future <br />availability of return flows from transmountain <br />diversions to the South Platte basin. The potential <br />impact of municipal wastewater recycling schemes will <br />be investigated. <br /> <br />-10- <br />
