<br />. <br /> <br />. <br /> <br />the Contractor shall transfer to the Uniteq States custody and use of' all <br />equipment, materials, and supplies used or useful in the performance of such <br />work; permit the United States, its contractors and its agents ingress to and <br />egress from the lands and Project works and facilities of the Contractor and, <br />for the performance of such work; and assign to the United States its interest <br />in any contract for the performance of work or the supplying of equipment or <br />material in connection with such work where requested by the United States <br />and agreed to by the other contracting party; or <br /> <br />(2) Declare the Project completed within the provisions of <br />Article 2 hereof by giving written notice to the Contractor, in which event <br />repayment of the loan obligation, including the determination of the amount <br />thereof, shall be carrieq out in accordance with the provisions of said <br />article: Provided, That the first annual,payment shall become due in the <br />year following the year in which the Contractor is notified of such declara- <br />tionof completion. <br /> <br />(b) In the event that the United States shall proceed as provided <br />in (a)(l) of this article, the United States may, at any time and regardless <br />of the progress of work performed thereunder, declare the Project completed <br />by giving written notice thereof to the Contractor, in which event the provi- <br />sions of (a)(2) of this article shall apply: provided, That the loan obliga- <br />tion shall include all expenditures of the United States made pursuant to the <br />provisions of (a)(l) of this article including related costs of the character <br />d~scribed in Article 6 hereof: Provided further, That the loan obligation shall <br />not exceed the limitation specified in Article 4 hereof. <br /> <br />'(c) Upon the giving of the written notice to the Contractor as pro- <br />vided in (a)(2) or (b) of this article, the United States shall have the right, <br />without further notice, to take over the care, operation, and maintenance of <br />the Project works in the same manner, to the same extent, and upon the same <br />conditions as prescribed in Article 11. <br /> <br />REVIEW AND INSPECTION OF PROJECT WOlL~S FOR <br />DETERMINING ADEQUACY OF MAINTENANCE <br /> <br />18. (a) The Contracting Officer with the Contractor may, from time to <br />'time, make reviews of maintenance" of Project works being operated by 'the <br />Contractor with a view to assistin~ the Contractor in determining the condition <br />of facilities and the adequacy of the maintenance program. This review may <br />include any or all of the the Project facilities constructed by the United <br />States and transferred to the Contractor or Project facilities constructed by <br />the Contractor with funds advanced by the United States. A report of the <br />review, including recommendations, if any, will be prepared and copies will be <br />'furnished to the Contractor. Except for such participation by the Contractor <br />as it may desire, 'the review will be without cost to the Contractor. <br /> <br />(b) If deemed necessary by the Contracting Officer or requested by <br />the Contractor, special inspections of any Project works being operated by the <br />Contractor and of the Contractor's books and records may be made to ascertain <br />the extent of any operation and maintenance deficiencies, to 'determine the <br />remedial measures required for their correction, and to assist the Contractor <br /> <br />17 <br /> <br />Articles 17 and 18 <br />
