<br />WHEREAS, re1luired approval. clearance and coordination has been accomplished from and with appropriate

<br />WIIEREAS." pursuant to the provisions of 37-60-119; Colorado Revised
<br />Statutes 1973, as amended, the State is authorized to construct certain
<br />water projects for the benefit of the people of the State of Colorado;
<br />and
<br />
<br />WHEREAS, the Blue River Water District has made application to the
<br />State for the construction of a water project for the purpose of
<br />improving municipal water supply in the District; and
<br />
<br />WHEREAS, the Contractor is a professional engineering firm within
<br />the State of Colorado and has previously done considerable water-
<br />related work for various entities in ColoradO;
<br />
<br />NOW THEREFORE, it is hereby agreed that
<br />
<br />1. The Contractor shall prepare a feasibility report directed to the
<br />problem of improving the municipal water in the Blue River Water
<br />District in accordance with a p~oposa1 for project feasibility
<br />report prepared by the Contract9r and approved by the State,
<br />received May 6, 1980, which proposal is attached hereto as Appendix
<br />A and made a part of this contr~ct.
<br />
<br />2. Fifteen (15) copies of the report called for in this contract shall
<br />be furnished to the State not 1a~er than September 15, 1980 unless
<br />such time is extended by mutual agreement of the parties hereto.
<br />
<br />3. As compensation for the services pf the Contractor, the State agrees
<br />to pay the Contractor the sum of ~leven Thousand Five Hundred Dollar,
<br />($11,50cr) in the manner following:
<br />
<br />a. Sixty percent (60%), to wit, Si~ Thousand Nine Hundred Dollars
<br />($6,900) of the total amount du~ in two (2) monthly installments
<br />of Three Thousand Four Hundred Fifty Dollars ($3,450) each.
<br />
<br />b. The remaining forty percent (40%) , to wit, Four Thousand Six
<br />Hundred Dollars ($4,600) within thirty (30) days following receip
<br />and acceptance of the written report specified in paragraph 2 of
<br />this contract.
<br />
<br />4. The total cost of services to be rendered by the Contractor is !Went.
<br />Three Thousand Dollars ($23,000) and the Blue River Water District
<br />shall pay the sum of Eleven Thousand Five Hundred Dollars ($11,500)
<br />as agreed to by letter dated May 30, 1980, which letter is hereby
<br />attached hereto and made a part of this contract as Appendix B; and
<br />in no event sha 11 this payment by the liabili.ty of the State of
<br />Co19rado.
<br />
<br />5. This contract is personal in nature and assignment of performance by
<br />the Contractor to another is prohibited unless prior approval in
<br />writing is granted by the State.
<br />
<br />6. The Contractor is an independent Contractor and as such is not
<br />entitled to any benefits of the State Personnel System.
