., <br />RESOLUTION <br /> <br />WFEREAS, the Division of Wildlife is mandated to protect, preserve, and <br />enhance fish and wildlife in Colorado. <br />WHEREAS, the Division of Wildlife has been heavily involved in identifying <br />impacts to fish and wildlife from the Stagecoach Reservoir project; and has <br />prepared mitigation recommendations for those project impacts. <br />l~l-EREAS, H.B. 1158 legislatim directs the Division of Wildlife to advise <br />the Colorado Wildlife Commission; and the Colorado Wildlife Commission to <br />advise the Colorado Water Conservation Board regarding the probable impact of <br />the Stagecoach Reservoir project on fish and wildlife resources and their <br />habitats, and to make recommendations regarding reasonable mitigation actions <br />for those impacts. <br />NOW Tf-EREFORE BE IT RESOLVED, that the Colorado Wildlife Commission <br />recommends the following measures be adopted by the Colorado Water <br />Conservation Board as the State of Colorado's official position on mitigation <br />for this project: <br />Mitigation - include all requirements in the Stagecoach Reservoir Project <br />Environmental Commitment Plan, plus; <br />1) The Upper Yampa Water Conservancy District (District) will not <br />oppose a filing by the Colorado Water Conservation Board for an <br />instream flow right on the Yampa Rvier below Stagecoach Reservoir. <br />2> The District will offer to donate sufficient water or water <br />rights to the Colorado Water Conservation Hoard to meet the release <br />requirement of 20 cfs from from August 1 through November 30, <br />annually, for the purpose of providing stream flows to preserve the <br />natural environment to a reasonable degree. <br />3) The District will install, operate, and maintain equipment at the <br />flow gaging stations above and below the reservoir to put those flaw <br />records an the Colorado Division of Water Resources' WATERTALK <br />Network. <br />4) Ttie District will submit official, daily inflow and outflow <br />gaging reports to the Division of Wildlife"s Grand Junction office <br />twice per year. <br />5) The term of the conservation easement to be dedicated to the <br />Division of Wildlife for the 672 acres on Blacktail hbuntain shall be <br />perpetual. However the District may periodically request the <br />Division of Wildlife to evaluate whether the conservation easement is <br />still serving its purpose. If the purpose of this mitigation measure <br />to provide habitat for "elk antl other wildlife" is no lrnger needed, <br />or the area no longer serves that purpose, the conservation easement <br />can be amended or terminated. <br />Exhibit A <br />
