C. loannides, P.E., Chief Project Planning and <br />Construction Section <br /> <br />Dear Mr. Ioannides: <br /> <br />In connection with the proposed contract between the San Luis Valley <br />Water Conservancy District and the Colorado Water Conserva~ion Board for <br />the purpose of preparing a feasibility report directed to the determination <br />of the physical and legal availability of water in the upper Rio Grande <br />Basin, I have examined the records and minutes of the San Luis Valley Water <br />Conservancy District, and the proposed contract between the District and <br />the Colorado Water Conservation Board, and wish to advise you as follows: <br /> <br />I. The signature of the person signing for the San Luis Valley <br />Water Conservancy District is that 0= an official duly elected to the Board <br />of Directors of the San Luis Valley Water Conservancy District. <br /> <br />2. The person signing for the entity has the authority to bind the <br />San Luis Valley Water Conservancy District, and I wish to further advise <br />you that the contract has been validly approved by the San Luis Valley Water <br />Conservancy District's governing body at a regular meeting of the district <br />held on December 9, 1986. A copy of the minutes approving this contract <br />are attached hereto. <br /> <br />3. The governing body of the San Luis Valley Water Conservancy District <br />has the authority to enter into the contract without a vote of the residents <br />of the district, as this contract comes within the "water supply exception" of <br />the Colorado Constitution, Article II, Section I. <br /> <br />4. <br />other state <br />Luis Valley <br /> <br />There are no other provisions in the charter or by-laws, or any <br />or local law that prevents this contract from binding the San <br />Water Conservancy District. <br /> <br />5. This contract will be valid and binding against the San Luis Valley <br />Water Conservancy District, if entered into by the State of Colorado. <br /> <br />~"."
