<br />.- <br /> <br />. <br /> <br />. <br /> <br />MEMORANDUM <br /> <br />To: <br /> <br />From: <br /> <br />CWCS Feasibility Report Contract - No. C153484 File <br /> <br />Tim Feeh,", P .E., W,te, S,pply PI,"oiog '"' FI",o", S,ctloo ~ <br /> <br />January 31,2000 <br /> <br />Date: <br /> <br />Subject: <br /> <br />Repayment of Feasibility Report, San Luis Valley Water Conservancy <br />District, Monte Vista, Colorado - Contract No. C153484 <br /> <br />Backqround <br /> <br />On January 5,1997, the Colorado Water Conservation Board (the State) entered into <br />a Contract with the San Luis Valley Water Conservancy District (the Contractor), to <br />determine the physical and legal availability of water in the Upper Rio Grande Basin, in <br />accordance with the feasibility proposal prepared by Leonard Rice Consultanting Engineers, <br />Inc, As compensation for the services of the Contractor, the State would pay to the <br />Contractor the sum of $72,000. Subsequently the Contract was amended on two separate <br />occasions, once on October 7,1997, for a time extension, and again on July 11,1998 for an <br />additional encumbrance of $71,000 by the State to compiete the report. The actual total <br />cost of completing the report was $180,000, of which $143,000 was provided by the State, <br />$33,000 provided by the Bureau of Reclamation, and $4,000 provided by the Contractor. <br /> <br />Paragraph 5, Section 5 of the amended Contract, dated July 11, 1988, states "In <br />consideration of the State providing a portion of the cost of the preparation of the said project <br />feasibility report, the Contractor shall pay to the State the sum $185,185, provided that <br />construction of the subject water project is initiated within 10 years of the date of this <br />Contract. The Contractor shall fulfill this obligation irrespective of how or by whom or to what <br />specifications or plans the subject project is financed, paid, or constructed for so long as <br />construction of said project is initiated within the specified time", <br /> <br />The final report, entitled "Rio Grande Water Supply Study", Phase I, was completed <br />by Leonard Rice Consulting Water Engineers, Inc" in January of 1990. Within the report, 4 <br />separate potential reservoir sites were discussed, that would fall under the category of a <br />water project, if actually constructed. They were Wagon Wheel Gap, Vega Sylvestre, Rio <br />Grande No,1, and South Fork No, 1, The remainder of the report dealt specifically with <br />water supply, water use, water rights, Rio Grande Compact, river modeling, and other <br />applicable research items required in developing the proposed reservoir sites, <br /> <br />Based on the terms of the Contract, the Contractor shall repay to the State the sum of <br />$185,185 if the water projects identified above were constructed prior to July 11, 1998. <br /> <br />Attached is a copy of the executive summary of the final published report. <br />
