<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Agenda Item 14a. <br />September 22, 1997 <br /> <br />2 <br /> <br />DISCUSSION <br /> <br />The proposed project involves replacement of the existing diversion (two dams and an aging <br />headgate), with a single new diversion and headgate structure, located just upstream, The new <br />diversion will maintain the current capacity of about 450 CFS, with an ability to supply about <br />900 acre feet of water per day, during irrigation season, In 1996, 44,000 acre feet was diverted <br />through the structure, of which 21,400 acre feet was placed in storage in the Julesburg <br />Reservoir, according to S,E,O, records, 19,000+ acres are irrigated under the District. <br /> <br />200 shareholders depend on this diversion and headgate for water deliveries, Without the <br />diversion, most will be without irrigation water in 1998, <br /> <br />The District is attempting to get emergency grant funding from several sources, Baring this, <br />the District will fund 25 % of the project from its own resources, with the remaining 75 % <br />($590K maximum) funded by an emergency loan from the CWCB. <br /> <br />Water diverted by the District is used for agricultural purposes, The loan should thus be at the <br />"Agricultural" rate of 3,75% for 30 years, as set by the CWCB November 25, 1996, <br /> <br />The District needs to complete the rehabilitation project prior to runoff in 1998, to allow <br />irrigation diversions in 1998, Temporary sand dams will not work, This loan may be from the <br />Emergency Infrastructure Repair Account, because the affected structure is a raw water <br />diversion, because the emergency is due to a sudden and unpredicted failure, because the <br />emergency threatens damage to property and crops, and because the project is a sensible solution <br />to the problem, The delay associated with General Assembly approval of this project would <br />result in undue hardship on the borrower, <br /> <br />COLLATERAL <br /> <br />The CWCB can take a collateral interest in the stream of revenue from shareholder assessments, <br />The District can also provide a certificate of deposit in amount of one annual payment be held <br />by the State Treasurer, and a deed of trust in real estate owned (all or part of the Julesburg <br />Reservoir site,) <br /> <br />STAFF RECOMMENDATION <br /> <br />The staff recommends: <br /> <br />1, That the CWCB fmds that the Julesburg Irrigation District is eligible to apply for a <br />loan from the Emergency Infrastructure Repair Account because the project is necessary <br />to avoid unreasonable risk of injury or damage to human health or well-being or to <br />property or crops, and because the emergency condition is not the result of negligence <br />in the operation or maintenance of the infrastructure, and <br />
