Edwards' plans for augmentation were decreed in <br />Consolidated Case Nos. 81CW161 and 81CW195 and in Case No. 92CW295. Only the <br />water rights which were acquired from Eagle-Vail in Case No. 92CW295 are included in the <br />exchange to Eagle Park Reservoir. These water rights are identified in Table 4 as "Eagle- <br />Vail/Edwards" in the column titled "Metropolitan District". Specifically, 19.5 acre-feet of <br />the 45 acre-feet of historical consumptive use acquired from Eagle-Vail are available for <br />exchange to Eagle Park Reservoir. The remaining 25.5 acre-feet are used to replace the <br />out-of-priority depletions caused by residential in-building and irrigation purposes at the <br />Cottonwood development. <br /> <br />UERWA. UERWA contracted for 220 acre-feet of water from Green Mountain Reservoir. <br />This water is used pursuant to the plan for augmentation decreed in Case Nos. 92CW291 <br />and 92CW295 to replace out-of-priority depletions with respect to the mainstem Colorado <br />River during the non-irrigation season. This water essentially substitutes for the storage <br />releases from the reservoirs described in the aforementioned plans for augmentation. In <br />Case No. 95CW348, the water stored in Green Mountain Reservoir can be exchanged to <br />Eagle Park Reservoir during the mid to late summer. The water would be released from <br />Eagle Park Reservoir to replace the out-of-priority depletions during the non-irrigation <br />season and to enhance Eagle River streamflows. <br /> <br />Vail Associates, Inc. <br /> <br />Vail Associates, Inc. (VAl) diverts water for snowmaking purposes from Gore Creek <br />and the Eagle River for the Vail Ski Area, and from the Eagle River just below Beaver Creek <br />for the Beaver Creek and Arrowhead Ski Areas. The snowmaking season is October <br />through March but fluctuates annually within these months depending on natural snowfall. <br />VAl has contracts with the U.S. Bureau of Reclamation totaling 1,759 acre-feet annually <br />from Green Mountain Reservoir for snowmaking at the Beaver Creek and Arrowhead Ski <br />Areas. Only 659 acre-feet of the contracts are included in the proposed exchanges to <br />Eagle Park Reservoir in Case No. 95CW348. The contract water is released from Green <br />Mountain Reservoir to replace out-of-priority depletions caused by the snowmaking <br />diversions with respect to river calls originating from the Colorado River. VAl acquired 500 <br />acre-feet of water from Cyprus' predecessor derived from pumpage by the Arkansas Well <br />and storage in Chalk Mountain Reservoir. This water is delivered to the Eagle River to <br />replace snowmaking diversions. VAl also acquired up to 300 acre-feet of Black lakes <br />water for use at the Arrowhead and Beaver Creek Ski Areas from Vail Valley. The Black <br />lakes water, however, is limited in quantity and timing and depends on Vail Valley's first <br />use. The exchanges set forth in Case No. 95CW348 will allow VAl to store its Green <br />Mountain Reservoir contract water, snowmaking return flows, and historical consumptive <br /> <br />9 <br />
