The water rights held by
Beaver Creek and by Smith Creek are not included in the exchanges to Eagle Park Reservoir
in Case No. 95CW348.

Arrowhead Metropolitan District. The Arrowhead plan for augmentation was decreed in
Case No. 80CW397. The future consumptive use was quantified as 136 acre-feet annually
for residential water uses (part is associated with Smith Creek Metropolitan District), 213
acre-feet annually for golf course irrigation, and 21 acre-feet annually for evaporation from
the golf course ponds. The out-of-priority depletions are replaced by historical consumptive
use during the irrigation season, May 13 through October 10, and from storage releases
during the non-irrigation season. The historical consumptive use, 496 acre-feet annually,
was derived from irrigation of 302 acres by ditches diverting from the Eagle River and from
McCoy Creek. The water rights included in the plan for augmentation were distributed
among the Arrowhead Metropolitan District, Smith Creek Metropolitan District, Country
Club of the Rockies, Inc. and Vail Associates, Inc. The Arrowhead Metropolitan District
obtained 79 acre-feet of historical consumptive use of which 76.2 acre-feet would be used
to replace out-of-priority depletions caused by municipal uses and evaporation from
Arrowhead Reservoir. The remaining 2.8 acre-feet would be available for exchange to
Eagle Park Reservoir distributed monthly as shown in Table 2.

Berry Creek Metropolitan District. The Berry Creek plan for augmentation was decreed in
Case No. W-3999. The future consumptive use was estimated to total 465.6 acre-feet
annually of which 30.6 acre-feet are attributable to in-building uses, 157.8 acre-feet are
attributable to residential lawn irrigation, 264.2 acre-feet are attributable to golf course
irrigation and 13.0 acre-feet are attributable to evaporation from storage ponds. The out-
of-priority depletions are replaced by historical consumptive use during the irrigation
season, May 13 through October 10, and storage releases during the remainder of the
year. The historical consumptive use of 562.7 acre-feet annually was derived from
irrigation of 388 acres by ditches diverting from the Eagle River, Berry Creek and June
Creek. The water rights included in the plan for augmentation were distributed among
Berry Creek, the Singletree Golf Club and June Creek Ranch Company. Berry Creek
obtained 221.9 acre-feet of historical consumptive use to replace its municipal depletions
and its share of the evaporation from June Creek Reservoir. Berry Creek's remaining
historical consumptive use, 25.9 acre-feet, is available for exchange to Eagle Park
Reservoir as shown in Table 2.

8
