<br />All payments due such subcontractors and consultants shall be the <br />sole responsibility of the Contractor. Such subcontractors and <br />consultants shall have no claim, lien, or cause of action <br />whatsoever against the State because of the Contractor's failure <br />to make payments to any such subcontractor or consultants for the <br />services rendered, or expenses incurred, by them. <br /> <br />12. It is understood and agreed that the following services <br />will be obtained by the Contractor from the listed <br />subcontractors and consultants, to wit: <br /> <br />A. Geotechnical Drilling <br /> <br />Boyles Brothers Drilling Company <br />15865 W. 5th Avenue <br />Golden. CO B0401 <br /> <br />B. Aerial Surveys and Topo Mapping <br /> <br />Towill Inc. <br />608 Howard Street <br />San Francisco, CA 94105 <br /> <br />C. Laboratory Testing <br /> <br />Atec Associates, Inc. <br />4860 Iron ton <br />Denver, CO 80239 <br /> <br />The Contractor may not obtain the services of firms other than <br />those listed above for the sUbject matter areas set forth unless <br />advance approval is given in writing by the State. <br /> <br />13. The Contractor shall not commence work under this contact <br />until it shall have Qbtained all insurance required under this <br />paragraph and such insurance shall have been approved by the <br />State, nor shall the Contractor allow any subcontractor to <br />commence work on its subcontract until all insurance required of <br />the subcontractor shall have been so obtained and approved. The <br />minimum insurance required hereunder shall include: <br /> <br />A. Workers' Compensation Insurance: The Contractor and <br />each subcontractor or consultant shall comply with the <br />Workmen's Compensation Act of Colorado (Articles 40 through <br />54. Title B. CRS. if applicable). <br /> <br />B. Liability Insurance - The Contractor shall maintain in <br />effect. employer's liability, professional liability, <br />comprehensive general liability (bodily injury and property <br />damage), and comprehensive automobile liability (bodily <br />injury and property damage) insurance with respect to <br />employees and vehicles of the Contractor assigned to the <br />prosecution of work under this contract in a maximum amount <br />not less than Eight Hundred Thousand Dollars ($800.000) for <br />each occurrence. The Contractor will supply to the State a <br />certificate of each such insurance and subsequent renewals, <br />each of which must contain the following provisions (to <br />provide the indicated protection to the State): <br /> <br />The State of Colorado, acting by and through <br />the Colorado Water Conservation Board <br />(hereinafter "the State"), is a named insured <br />for all coverages (including automobile) <br />provided by this policy of general <br />comprehensive insurance and shall be fully <br />and completely protected to the extent <br /> <br />Page 4 of 8 Pages <br />
