Claim for Delay

Dear Rick:

As provided in the Contract Specifications. Section 9.11 of
the General Conditions we are SUbmitting the following requests
for additional information in order to clarify your claim. The
following questions refer to your claim letters dated May 1.
1989 and June 5. 1989 respectively. On the basis of our
records of notices to proceed on divisions I, II, and III A and
B we are unable to determine the validity of your claim for the
loss of 64 working days. Therefore please respond to the
fOllowing questions for supplementary information according to
each letter.

The questions are as follows:

A. Letter dated Mav I, 1989

1. We have never received a progress (work) plan indicated
in paragraph two of your letter. Please submit it and
indicate:

(a) Has it been submitted before and if so when and to
whom.
(b) Explain the progress plan and tell us how it
becomes relevant to the claims submitted.

2. Explain with all background information why you think
that Division II work was to start January 2. 1989.
Please quote all necessary documents supporting your
position. The question refers to paragraph 3 of your
letter.

3. In the second sentence of paragraph 3 of your letter
you talk about the intent of your company, Please tell
us when you notified MKE or the Colorado Water
Conservation (CWCB) Board about what your intent was.
