Walker <br />Deputy Director <br /> <br />FROM: <br /> <br />DATE: <br /> <br />SUBJECT: Contract with the Ute Mountain Ute Tribe for the <br />Construction of the Towaoc Pipeline Project <br /> <br />When the Towaoc Pipeline Project was authorized, the Water <br />Conservation Board was also authorized by section 1(4), Chapter <br />230, Session Laws of Colorado 1986, to contract with the Ute <br />Mountain Ute Tribe for the construction of the project if the <br />Board is satisfied that the reguired work can ,be satisfactorily <br />performed. The Tribe, through its wholly owned subsidiary, the <br />Weminuche Construction Authority, does desire to construct the <br />project. Therefore, i have thoroughly evaluated the <br />Authority's gualifications and have concluded that it is <br />competent to construct the project. <br /> <br />Under the circumstances, I am prepared to proceed to enter <br />into a negotiated contract with the Tribe, the competitive <br />bidding processes of ArtiCle 92 of Title 24, CRS, having been <br />waived by the above cited authorizing legislation. The purpose <br />of this memorandum is to reguest you to: <br /> <br />(1) Prepare-the necessary contract between the Board and <br />the Tribe (Authority?), a draft of which as prepared <br />by MKE is enclosed, and <br /> <br />(2) Review and approve or modify the other enclosed <br />contract documents, which have also been prepared by <br />MKE as part of their work for us. <br /> <br />In order to meet our construction schedule, I need to have <br />the contract between the Board and the Authority executed and <br />completed by June 1, 1988.
