December 15, 1989 Mr. Glenn Pruitt Morrison-Knudsen Engineers, Inc. 22763 County Road G.2 Cortez, Colorado 81321 Subject: Towaoc Municipal Projects, Division II Time Extension Dear Glenn, Due to numerous delays in Division II work that have been beyond our control and not the fault of Weeminuche Construction Authority we request an extention in the contract time for the Division II work. It is the stated intent of the contract documents that Division II work could start no later than December 31, 1988. The contract documents under Section 01012, Contractor's Construction Schedule, Contractor shall not schedule to submit a progress schedule, Contractor shall not schedule work on this part (Division III of the project prior to December 31, 1988. Contractor will be provided the full alignment by December 31, 1988." During the construction of the Division I phase of the project in the late Fall and early Winter of 1983 we became aware, thru discussions at meetings, that the Colorado Water Conservation Board, in all probability, would not be able to abide by their commitment to "provide the full alignment by December 31, 1988." After starting the work in the Division I phase it has been our intent to increase our work force to two crews and essentially have Division I work completed by the latter part of December 1988, We would then move on with similar work in an orderly manner into the Division II phase by December 31, 1988 without interuption. Our intended manner of addressing the Division II work did not occur. After '. learning of the probability that Division II work would not be provided by December 31, 1988 we did not have justification to increase our work force for the Division I work to the intended two crews. Work was continued on Division I thru early 1989 and ultimately completed on this phase on March 2, 1989 at which time most of our project personnell were laid off and equipment was placed on standby. The Colorado Water Conservation Board, because of unanticipated right of way acquistion problems, did not provided any Notice To Proceed on Division II work until May 8, 1989, At that time only 10,050 lineal feet became available for construction of the approximately 62,000 lineal feet of pipeline in Division II.
