<br />A. Unforeseen delays in Right-of-Way acquisition which
<br />required the Contractor to schedule his work intermittently
<br />and therefore increased his costs for said work due to idle
<br />equipment and non-chargeable labor; and,
<br />
<br />B. Extensive changes in alignment which increased the mate-
<br />rials required by a substantial amount and changed the
<br />working conditions in several areas which also resulted in
<br />increased costs for the work; and,
<br />
<br />C. Also see documents dated March 2, 1989; May 1, 1989; June
<br />5, 1989; December 15, 1989; December 20, 1989; and January
<br />2, 1990, attached hereto and incorporated herein as Exhi-
<br />bits B, C, D, E, F and G, respectively as supporting Con-
<br />tractor's claims and costs.

<br />DATE OF COMPLETION
<br />
<br />2. The dates for Substantial Completion of the Work for
<br />Division II required under the Agreement are as stated in the
<br />letter from Rick Reck to Glen pruit dated January 15, 1990,
<br />attached hereto and incorporated herein as Exhibit H.
<br />
<br />RELEASE
<br />
<br />3. Upon receipt of all of the foregoing payments, for
<br />good and valuable consideration, the receipt and sufficiency of
<br />which is hereby acknowledged, Contractor on its own behalf and on
<br />behalf of its officers, directors, shareholders, partners,
<br />agents, employees and elected officials, past and present, and
<br />all of its subcontractors, suppliers, sureties, insurers, succes-
<br />sors and assigns, hereby forever releases and discharges Owner
<br />together with all of its officers, directors, shareholders,
<br />agents, employees, and elected officials past and present, and
<br />all of its subcontractors, suppliers, sureties, insurers, succes-
<br />sors and assigns, from any and all claims, debts, damages, liens,
<br />causes of action, suits, liabilities, controversies, obligations,
<br />demands, and rights to time extension, together with all liqui-
<br />dated and other delay damages, whether in law or in equity, con-
<br />tract or tort which the Contractor may have had or might now
<br />have, and which are presently known and unknown, foreseen and
<br />unforeseen, for any and all costs and expenses incurred, includ-
