<br />. <br /> <br />. <br /> <br />BOCC Hinutes <br />May 18, 1988 <br />Page 2 <br /> <br />Bruce Baumgartner, County Nanager, reported on the proposed one year option to <br />purchase Can,ood Ditch \,ater rights and indicated that this matter had been <br />continued as the Board requested a status report. err. Baumgartner delivered <br />an oral status rpport to the Board. Bennett Grove, of ~lOlmtain Affiliates in <br />Frisco, requesting an option to purchase water rights, reported on the status <br />of development on Summit Estates. Also,Lee Brill, a developer requesting an <br />option to purchase water rights, reported on the history in attempting to <br />acqui re \,llter and the present status of development of The Summit of <br />Breckenrido:e. Nr. Grove and ~rr. Brill, both reiterated to the Board their <br />needs for the option to purchase the Carwood Ditch Hater rights. Rick <br />Bunchman, representing Nr. Henry Kuras, commented on Nr. Kuras' interests in <br />the option agreement to purchase Can,ood Ditch "llter rights. Nr. Baumgartner <br />read to the Board the comments from the Summit County Planning Department <br />regaming ~rr. Brill's development and rezoning plans. Nr, Brill stated as a <br />matter of record, that as far as he is concerned, the reason that the <br />preliminary approval was not moved fon,-am to a detailed submittal and further <br />fOTh'ard was hecause of the question of \,-ater rights Hhich he had been aHare of <br />that the COlmty "-as trying to make available to small developers for a number <br />of years nOH, and that he did not become aware of the fact that an option <br />could be acquired for the Can,ood Ditch Water Rights until the last Board of <br />County Commissioners' meeting. Discussion included the availability of water <br />from other sources, the start dates of the subdivisions, and the economics of <br />the projects. ~rr. BaUll\gartner suggested a motion to the Board in revising the <br />option agreement. <br /> <br />I'mION: <br /> <br />Commissioner Ulmer moved to authorize the Chairman of the Board of <br />County Commissioners to exercise an option agreement with Summit <br />Estates in the amount of 2.0 acre feet of CaTh'ood Ditch Water Rights <br />and the appropriate Dillon storage rights according to the County's <br />previous option agreement and terms; and to authorize the Chairman <br />to execute an option agreement Hith The Summit of Breckenridge in <br />the amount of 1.5 acre feet of Carwood Ditch Water Rights and the <br />appropriate Dillon storage rights according to the County's previous <br />option agreement and terms; and further, that if the Lee Brill (The <br />Sl~mit of Breckenridge) option is not exercised within its term, <br />that the 1.5 acre feet be then made available to Henry Kuras if he <br />still has a need for it. Commissioner Peterson seconded the motion, <br />Commissioner Peterson addI'essed the cost of storing 1.0 acre foot in <br />the Dillon Reservoir.
