This contract amendment is a supplement to the Original <br />Contract (Attachment A). which is by this reference <br />incorporated and made a part hereof; and all the <br />terms. conditions. and provisions thereof. unless specifically <br />modified herein. are to apply to this contract amendment as <br />though they were expressly rewritten. incorporated. and <br />included herein. <br /> <br />3, <br />Original <br />sha 11 be <br /> <br />The only mOdifications. alterations. or changes in <br />Contract shall be that paragraphs 2. 3. 4, 5, and <br />modified to read as follows: <br /> <br />the <br />6 <br /> <br />2. The study shall be completed and twenty (20) <br />copies of the said report shall be furnished to the State <br />not later than November 30. 1989. unless such time is <br />extended by mutual agreement of .the parties -hereto in <br />writing. which extension may be accomplished by letter <br />agreement separate and apart from this contract and without <br />amending this contract. <br /> <br />3. As compensation for the services of the <br />Contractor. the State shall pay 1:0 the Contractor the sum <br />of Seventy Thousand Dollars ($70,000) in the following <br />manner: <br /> <br />a. Thirty-Six Thousand Dollars ($36.000). paY'able in <br />two (2) monthly installment!:: of Eighteen Thousand <br />Dollars ($18.000) each. with the first installment <br />payable sixty (60) daY'S after the date of this <br />contract. <br /> <br />b. The remaining Thirty-Four Thousand Dollars <br />($34.000), payable within forty (40) days following <br />receipt and acceptance by the State of the report <br />specified in paragraph 2, <br /> <br />4. In addition to the Seventy Thousand Dollars <br />($70.000) from the State. the Contractor shall contribute <br />Thirty Thousand Dollats ($30.000) toward the cost of <br />preparing the study and the report for which this contract <br />calls. In no event shall this sum be the responsibility of <br />the State. <br /> <br />5. In consideration of the State assuming a portion <br />of the cost of the preparation of the said study and <br />report. the Contractor shall pay to the State the sum of <br />Ninety Thousand Six Hundred Fitty Dollars ($90.650) if. but <br />only if. construction on any wate! project identified in <br />the report is initiated by the COJltractor within ten (10) <br />years of the date of this contract. The Contractor shall <br />fulfill this Obligation irrespective of how or by whom such <br />project is financed and paid for ilnd irrespective of to <br />what final specifications and plaIls such project is <br />constructed. <br /> <br />6. In the event the Contrac1:or must make payment <br />pursuant to the terms of paragrapll 5 above. then the said <br />sum of Ninety Thousand Six Hundrec FiftY' Dollars ($90.650) <br />shall be payable in ten (10) equal. annual installments of <br />Nine Thousand Sixty-Five Dollars ($9.065) each. the first <br />installment to be due and payable upon the January 1st next <br />succeeding the initiation of construction on the water <br />project. Subsequent payments shall be due and payable on <br />January 1st of each year thereafter. <br /> <br />4.
