Unit 77-77-777, <br />WHEREAS. re4uircd arrruy,d. c1ear:mce and coordinatiun ha~ b~~n accomplish~d hom and with approprial~ <br />lIg~nclt:s: and <br /> <br />WHEREAS. a contract was entered into on May 24. 1988. <br />Contract Encumbrance Number C153512 (the Original Contract). <br />between the State and the Contractor: and <br /> <br />WHEREAS. paragraph 2 of the Original Contract provides that <br />twenty (20) copies of a final report be furnished to the State <br />not later than December 31. 1988. unless such time is extended <br />by mutual agreement of the parties in writing. which extension <br />may be accomplished be letter agreement; and <br /> <br />WHEREAS. such a letter agreement was made and it extended <br />the time of completion and submission of the final report to <br />May 1. 19B9: and <br /> <br />WHEREAS. from information made available to the State by <br />the Contractor. it became necessary to further extend the <br />completion and submission time of the final report because the <br />preparation of the report was more complicated than originally <br />anticipated; and <br /> <br />WHEREAS. because of the extended time period. the total <br />cost of the study had to be increased by Forty Thousand Dollars <br />($40.000): and <br /> <br />WHEREAS. the Colorado Water Conservation Board in its <br />official meeting of May 11. 1989. authorized the increase of <br />State participation in the project by Ten Thousand Dollars <br />($10.000) provided that the Contractor and the Consulting <br />Engineer also participate in the cost overuns by Ten Thousand <br />Dollars ($10.000) and Twenty Thousand Dollars ($20.000). <br />respectively; and <br /> <br />WHEREAS. we have now been informed by the Contractor that <br />the cost-sharing money is available; and <br /> <br />WHEREAS. this contract could not be further extended by <br />letter agreement when the tirst extension terminated because it <br />was unknown at the time when the final report would be made <br />available. and the State was unwilling to provide more <br />completion time than what was absolutely necessary; and <br /> <br />WHEREAS. the State has been monit:oring the completion of <br />the study report: and <br /> <br />WHEREAS. the study report may be made available in final <br />form on November 1. 1989. <br /> <br />NOW THEREFORE it is hereby agreed that: <br /> <br />1. Consideration for this amendment to the Original <br />Contract.
