<br />State, nor shall the Contractor allow any subcontractor to <br />commence work on its subcontract u~til all insurance required of <br />the subcontractor shall have" been so obtained and approved." The <br />minimum insurance required hereunder shall include: <br /> <br />A. Workers I Compensation Insurance - The Contractor and <br />each subcontractor or consultant shall comply with the <br />Workmen's Compensation Act of Colorado (Articles 40 through <br />54, Title 8, CRS, 1973) if applicable. <br /> <br />, <br /> <br />B. Liabili"ty Insurance - The Contractor shall.maintain in <br />effect, to the extent that such insurance is available at <br />reasonable cost, employer's liability, professional <br />liability, "comprehensive general liability (bodily injury <br />and property damage), and comprehensive automobile liability <br />(bodily injury and property damage) insurance with respect <br />to employees and vehicles of "the Contractor assigned to the <br />prosecution of work under this contract in a maximum amount <br />of not less than $300,000. The Contractor will' supply to <br />the State a certificate of each such insurance and any <br />subsequent renewals, each of which must contain the <br />fOllowing provisions (to provide the indicated protection to <br />the State): <br /> <br />The State of Colorado, .acting by and through <br />the Colorado Water Conservation Board <br />(hereinafter lithe State"), is a named <br />insured for all coverages (including <br />automobile) provided by this policy of <br />general comprehensive insurance a'nd shall ,be <br />"fully and completely protected to the extent <br />provided in said policy for any and every <br />injury, death, damage and loss of any sort <br />.sustained by any person, organization or <br />corporation in connec.tion with any activity <br />performed by the Contractor (except for <br />professional liability) by virtue of the <br />provisions of that contract between ..the <br />State and the International Engineering <br />Company, Incorporated, for prOfessional <br />servi~es, for the feasibility study of the <br />Yellow Jacket Project dated December 21, <br />1981. The coverages provided by this policy <br />to the State or "any other additional insured <br />shall," not be terminated, reduced or <br />substantially changed without providing at <br />least thirty (30) days prior written notice <br />to the State; <br /> <br />14. Indemnification - The Contractor hereby agrees to save <br />harmless'- and defend the State from all claims and liability for <br />which the'Contractor has legal liability arising out of the <br />negl igent acts, errors, or omissions of the Contractor,' its <br />agents and/or employees in performing the work required by this <br />contract; provided, however, such defense, indemnification and <br />hold harmless shall not exceed the sum of the amounts paid to, or <br />qn behalf of, the Contractor- as the proceeds of any applicable <br />insurance plus the deductible amount of such insurance, as <br />described above in paragraph 13. <br /> <br />Page 5 of 8 Pages <br />
