The Paradox Valley Canal and Reservoir Company water rights have an appro- <br />priation and priority date in the State of Utah of June 1, 1892 and in the State <br />of Colorado of January 14, 1922. The water was first filed on in the State of <br />Utah in January, 1893 by the Stevens Land and Cattle Company and as due diligence <br />progressed the Company acquired an absolute decree for the storage of 3,000 acre <br />feet of water and 85 cubic feet of water per second of time in the State of Utah. <br />It was not until July 1, 1975 that the Paradox Valley Canal and Reservoir Company <br />applied to the State of Colorado to make the water rights valid in both states. <br />A copy of Case W-2645 in District Court, Water District No.4, appears in the <br />appendix of this report. <br /> <br />The State of Colorado granted the same water right to the Paradox Valley Canal <br />and Reservoir Company as the State of Utah had previously granted to the Paradox <br />Valley Canal and Reservoir Company. Both states have over appropriated the amount <br />of water in the drainage basin, since the Paradox Valley Canal and Reservoir Com- <br />pany own all the water rights the over appropriation of the available water is <br />inconsequential. <br /> <br />Water Utilization <br /> <br />When Table VII (Water Requirements) is compared with Table X (Water Available to <br />Paradox Valley) it can been seen that the Paradox Valley Canal and Reservoir <br /> <br />IV-5 <br />
