u � � � .. � � . <br />.� . <br />DOUGLAS C.OUNTY WATERRESOURCE AUTHORITY <br />PROJECT PARTICIPATION AGREEMENT <br />FOR <br />SOUTH METRO WATER SUPPLY STi3DY <br />WHEREAS, the Douglas Counry Water Resource Authority ("Authority") was established, <br />inter alia, to improve the quality of life of present and future residents of Douglas County and the <br />surrounding area, to improve water supply, and to improve the economic destiny of its members by <br />providing a forum for cooperative efforts towazd the development and operation of a stable and <br />efficient water system; and . <br />WHEREAS, the Establishing Contract that created the Authority ("Establishing Contract") <br />provided for the organization of projects of benefit to a specific group of the Members of the <br />Authority and others, subject to the agreement of such group of Members and others to the terms of <br />a Project. Participation Agreement that describes the project, its financing, and its governance; and <br />WHEREAS, the Members ofthe Authority consider the need for developing sustainable and <br />renewable water sources as an important element for the long term public heakh; safety and welfare <br />oftheir present and prospective water customers; and <br />WHEREAS, the members of the Authority see the need to act in a unified and cooperative <br />manner with respect to management of its potentially available water resources, including, but not <br />limited to, the Denver Basin aquifers underlying Douglas and Arapahoe Counties, the integration and <br />allocation of renewable supplies, wheeling and system integration, if appropriate, return flows and <br />tbe dischazge and use of ef�luent and other water sources; and <br />WHEREAS, the members of the Authority have, by Resolution No. 998-02, requested the <br />Denver Water Boud and Colorado River Water Conservation District to join in a Study (as defined <br />below) to assess the potential opportunities that may be realized through cooperative actions; and <br />WHEREAS, acting pursuant to the Establishing Contract, 5ection 18(2)(a) of Article XIV <br />of the Constitution of the State of Colorado, and Section 29-1-203, C.R.S., the Members and others, <br />if any, who have entered into this Agreement or an addendum hereto ("Study Participants"), have <br />found that it is in their respective best interests to enter into this Project Participation Agreement <br />("Agreement") to complete the Scope of Work for the South Metro Water Supply Study attacned <br />hereto as Exhibit t� and as may be amended from time to time ("Scope of Work"). <br />NOW, THEREFORE, for and in consideration of the premises and promises herean <br />contained, the sufficiency of which is hereby acknowledged, the Study Participants agree as follows: <br />G:\t2570�1\SOUthMehoAgroemmtl0.wptl + <br />�`t��ND1X � <br />
