It owns
151 of the preferred ~ights in Fossil Creek Reservoir
each right representing 1,000,000 cubic feet or
approximately 23 acre feet. It owns 445 shares in
the Arthur Ditch Company; 9 shares in the Larimer
County No. 2 Ditch Co~pany; 13 shares in the New
Mercer Ditch Company; and 21 7/8 shares in Taylor
and Gill Ditch Company. A table showing Reservoir
decrees and canal dec~ees are attached but some
conditional decrees and recent decrees are not
shown. These tables can be brought to date if
necessary.

North poudre believes that the water rights for
Fossil Creek make it probable that it will regularly
fill and that this will be true in the future.
There are also opport~nities to refill perhaps to
full capacity once in approximately 20 years and
opportunities to refill in amounts less than the
full capacity but in ~ultiples of 1,000 acre feet
depending on the season.

(2) North Poudre believes the most probable yield of
the water rights used for the proposed project
will be between 11,50S and 13,597 acre feet.

Water utilization.

(1) The principal amount of water available from the

-11-
