AND PHYSICAL IMPACTS <br /> <br />The NPIC #6 Outlet Ditch, NPIC #5 Spillway, and the Indian Creek Reservoir Spillway projects are <br />projects in rural areas that will have little or no social impact. The NPIC #4 Rehabilitation project will <br />prevent restrictions on reservoir water levels in NPIC Reservoir #4, which is leased to the Colorado <br />Division of Wildlife for fishing, Repairs made to the NPIC #4 Reservoir dam and spillway will have a <br />positive social impact by ensuring that fishing rights can be continued in the future. <br /> <br />The projects will have a positive economic impact providing a portion of the irrigation water for <br />30,000 acres of shareholders' crops, Improvements to spillways will bring Indian Creek Reservoir and <br />NPIC Reservoirs #4 and #5 into compliance with SEO regulations thus reducing liability in the event of <br />downstream flooding, The NPIC #6 Outlet Ditch Project will prevent encroachment of the ditch onto <br />neighboring properties and thus avoid a potential lawsuit by neighboring landowners. <br /> <br />The four selected projects will have slight but positive physical impacts, The NPIC #6 Outlet Ditch <br />and NPIC #5 Spillway Projects will provide erosion and flood protection to adjacent lands, and the <br />Indian Creek Spillway Project has potential for diverting flood waters away from existing homes. The <br />majority of construction involved with the projects will be on NPIC lands, <br /> <br />PERMITTING <br /> <br />The company will need to obtain easements at both the east and west ends of the dam at NPIC <br />Reservoir #5. Additionally, the company will need to obtain easements with a minimum of four <br />property owners at Indian Creek Reservoir. The United States Army Corp of Engineers (COE) has <br />been contacted about a 404 permit. It is understood that no permit is needed and NPIC will request a <br />letters of exemption from the COE for each project before construction begins. The NPIC and the <br />Engineer believe no Environmental Assessment (EA) or Environmental Impact Statement (EIS) will be <br />required for any of the projects. <br /> <br />Page 21 <br />
