Septic Tanks: Individual septic systems <br /> <br />with leach fields shall be placed on each Lot by the Owner <br /> <br />in accordance with the requirements of the Tri-County Health <br /> <br />Department. <br /> <br />ARTICLE VI <br /> <br />EASENENTS <br /> <br />Section 1. Reservation of Easements: Easements and <br /> <br />rights-of-way are hereby expressly reserved by Declarant <br /> <br />over each Lot for the creation, construction and maintenance <br /> <br />of utilities, such as gas, water, telephone, telegraph, <br /> <br />electricity, sewers, storm drains, public, quasi-public, and <br /> <br />private, as well as for any public, private, or quasi-public <br /> <br /> <br />utility or function deemed necessary or expedient for the <br /> <br />public health and welfare. Such easements and rights-of-way <br /> <br />shall be confined to the rear ten feet of every Lot and ten <br />--- <br /> <br />feet along the sid~_~f every Lot, and along every street of <br /> <br />the subdivision. <br /> <br />Section 2. Easements: Each Lot shall be subject to <br /> <br />all easements and rights-of-way shown or provided for, upon <br /> <br />any recorded plat of the Property. The Owner of any Lot <br /> <br />subject to and tr~versed <br /> <br />by any trail or ~_~~~_l~_ p.~th_ ~~~ement <br /> <br />or right-of-way shall be p_e!:~'?~_~llY.~e:.~1?.o~.:~bl_e_.~?~_~e <br />upkeep, repair and maintenance of the same in regard to that <br /> <br />portion of said easement or right-of-way which traverses his <br /> <br />Lot. Such easements or rightS-Of-way shall be kept, repaired <br /> <br />and maintained in accordance with the guidelines, rules and <br /> <br />regulations established by the Association. <br /> <br />ARTICLE VII <br /> <br />GENERAL PROVISIONS <br /> <br />Section 1. Enforcement: The Association, Committee, <br /> <br />or any Owner, shall have the right to enforce, by a proceed- <br /> <br />ing at law or in equity, all Covenants now or hereafter <br /> <br />imposed by the provisions of this Declaration.
