The designated maximum building height <br /> <br />requirements may be waived by the Conunittee when .in their <br /> <br />opinion, such structures relate to sound architectural <br /> <br />planning and land use, and conform to the overall design and <br /> <br />pattern of the development. <br /> <br />Section 4. Dwelling Cost: Quality and Size: No <br /> <br /> <br />dwelling shall be permitted on any Lot at a cost of less <br /> <br />than $55,000.00 based on cost levels prevailing on the date <br /> <br />this Declaration is recorded with the Adams County Clerk and <br /> <br /> <br />Recorder. The ground floor area of the dwelling, exclusive <br /> <br />of one story open porches and garages, shall be not less <br /> <br />than 1,500 square feet for a one story dwelling, nor less <br /> <br />than 1,300 square feet for a dwelling of more than one <br /> <br />story, excluding utility rooms and attics. <br /> <br />.Section 5. Time for Construction: Upon the approval <br /> <br />by the Conunittee of any plans and specifications submitted <br /> <br />------- <br /> <br />to it, the person who submitted the same shall proceed <br /> <br />diligently with construction of said impro~ements, which <br /> <br />construction must be conunenced no later than 6 months after <br /> <br />approval, and the same shall be completed and ready for <br /> <br />occupancy or use within a period of six (6) months time from <br />---- ------ --- -.- - ~.- -------...- <br /> <br />the date of construction begins; provided, however, that <br /> <br />this period may be extended by the Conunittee if said .extension <br /> <br />is made necessary by reason of inclement weather, inability <br /> <br />to obtain materials,. strikes, acts of God, etc. <br /> <br />Section 6. Occupancy of Structures: No structure <br />shall be occupied or used for the purpose for which it was <br /> <br />designed or built until it is approved and/or inspec~ed by <br />the County Building Inspector or similar official designated <br /> <br />by Adams County. No structure erected upon any Lot shall be <br /> <br /> <br />occupied in any manner while in the course of construction <br /> <br />nor at any time prior to its being fully completed, as <br /> <br />herein required. <br /> <br />-10- <br />
