<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />From a water resources point of view, the two main limitations on <br />water supply are physical availability and legal availability. <br />The feasibility of the alternative which proposed the construction <br />of new wells to supply the Town's water needs as described in the <br />previous section, will directly relate to the physical and legal availability <br />of groundwater to be diverted. The wells in the proposed alternative will <br />tap the shallow alluvial groundwater aquifer in the Lone Tree Creek drainage <br />basin to the north and east of Nunn, Prior to the construction and use <br />of water from the wells, a permit for drilling must be issued by the State <br />Engineer which is valid for one year. During this period, the well must <br />be drilled, a pump installed, andrwater used beneficially. A second form <br />substantiating the drilling and beneficial use must also be filed with <br />the State Engineer's Office, It should be noted that a permit will only <br />be issued if the State Engineer finds that there will not be any material <br />injury to existing senior water rights. <br />The Town of Nunn has experienced some problems related to water <br />rights in the past in relation to the use of the two existing shallow alluvium <br />wells which supply the bulk of the Town's water supply. In January 1963 <br />the Town was notified by the State Engineer 1hat the State believed that <br />the Tow1 might be misappropriating water fron the South Platte River, and <br />the State Engineer proposed a set of rules and regulations which would have <br />shut down the wells in 1976. The problem with the Town's rights to divert <br />water from the groundwater aquifer was solved by joining the Groundwater <br />Appropriations of the South Platte (GASP), an organization which combines <br />the augmentation requirements of many wells, thereby increasing the efficiency. <br />It is anticipated that because of the Town's association with GASP that the <br />Town will be able to construct the proposed wells in the Lone Tree Creek <br />basin to the north and east of Nunn without any serious legal problems. <br /> <br />22 <br />
