<br />J. <br /> <br />. <br /> <br />. <br /> <br />AGREE:1vlENT <br /> <br />1. <br /> <br />Definitions. The following defmirions shall apply herein: <br /> <br />a. <br /> <br />"Board" shall mean me Board of Direccors of [lJe Northern Colorado Water <br />Conservancy District. <br /> <br />b. <br /> <br />"Caner Lake [0 Broomfield Pipeline" shall mean me pipeline consrructed by me <br />SWSP Enterprise as part of the Southern Water Supply Project and for which <br />Allottee has an allorment contract dated January 14. 1.994. <br /> <br />c. <br /> <br />"Conrract" shall mean this Allotment contract dated as set forth above between <br />SWSP Enterprise and Allottee. <br /> <br />d. <br /> <br />"District" shall mean me Northern Colorado Water Conservancy District, a political <br />subdivision of the state of Colorado, and body corporate with all the powers of a <br />public or municipal corporation. organized and existing by virrue of title 37, <br />Article 45, Colorado Revised Statutes. as amended, which owns and controls the <br />SWSP Enterprise. <br /> <br />e. <br /> <br />"District water" shall mean all water that accrues to the use of the District or its <br />allottees by reason of the Colorado-Big Thompson Reclamation Project <br /> <br />f. <br /> <br />"Entity" shall mean any quasi-municipal corporation, limited liability company, <br />municipal corporation, public corporation. joint venture, partnership, person. mutual <br />ditch company. water users' association or privare corporation. <br /> <br /><T <br />". <br /> <br />"Fiscal Year" shall mean me fiscal year of me SWSP Enterprise. Currently. the fiscal <br />year of the SWSP Enterprise begins on October 1 and ends on September 30 of the <br />following calendar year. However. the SWSP Enterprise may change the Fiscal Year <br />during the term of this Contract <br /> <br />h. <br /> <br />"Fort LuptonlHudson Pipeline" shall mean the pipeline constructed by me SWSP <br />Enterprise as part of me Southern Water Supply Project and for which Allottee has <br />an allotment contract dated August 4, 1995. <br /> <br />1. <br /> <br />"GPD"shall mean gallons of water per day measured over a 24-hourperiod beginning <br />at 12:00 a.m. and terminating at 12:00 a.m. on me next day. <br /> <br />"Initial Participants" shall mean the Allottee and any ocher Enticy with an enforceable <br />conrract for an allocation of capacity in che Pipeline executed on or before July 17, <br />1998.
