The STATE shall allocate $12,000 of the grant funds to the USGS under this Joint Funding <br />Agreement and shall allocate the remaining funds to the MUSEUM under a separate <br />agreement. <br /> <br />I. The STATE has entered into a memorandum of understanding with the DWR under which <br />the DWR will deliver $10,000 to the CWCS per fiscal year for FY98-99, FY99-G0 and FY00-01 <br />to apply to STUDY costs ("State Agency MOU.). The State Agency MOU is incorporated <br />herein by reference. <br /> <br />J. The USGS will contribute $6,400 and Colorado State University will contribute $10,000 to <br />fund certain portions of the Study. -- <br /> <br />Now Therefore, in consideration of the mutual and dependent covenants contained <br />herein, the parties agree as follows: <br /> <br />1. Cooperation of parties. The parties agree to cooperate on the STUDY, subject to the <br />avaiiability of appropriations and in accordance with their respective authorities, by sharing in <br />the costs of the STUDY in conformity with the laws and regulations respectively goveming each <br />party in the amounts described below. <br /> <br />2. Study performance. The USGS will store the core, assist in hydrologic core analyses <br />and aquifer testing, and publish a report on the hydrologic aspects of the STUDY, in <br />accordance with the Scope of Study attached hereto as Appendix A and incorporated herein. <br /> <br />3. Time of performance. The USGS shall use its best efforts to complete the STUDY within <br />three (3) years from the date of this agreement. <br /> <br />4. Availability offunds, The parties agree that the performance of the STUDY is subject to <br />the availability of appropriations and that each party shall contribute to the costs of the STUDY <br />in conformity with the laws and regulations governing that party. During the period July 1, <br />1998 to June 30, 2001, the CWCS shall contribute a total of $12,000 and the USGS shall <br />contribute a total of $6,400 to cover STUDY costs. ' . <br />. The State has set aside $12.000 to contribute to the Study. <br />5. Disbursement of funds'A The STATE shall disburse funds to the USGS periodically as the <br />USGS submits statements to the STATE that set forth the STUDY tasks accomplished and <br />costs incurred for the time period covered by the statement. The STATE shall make such <br />disbursements within 60 days of receipt of a statement from the USGS. However, the STATE <br />shall not disburse any funds under this agreement until it has received documentation of the <br />MUSEUM'S receipt of funds for the STUDY from the National Science Foundation. <br /> <br />6. Access to study results, The original geo-hydrologic data and laboratory analyses <br />resulting from the STUDY shall be deposited in the USGS Colorado District office. The USGS <br />shall provide the STATE and the DWR with full access to and copies of the STUDY data and <br />analyses in both published and electronic form. <br /> <br />7. Availability of study results to public. The USGS shall publish a USGS Open-Rle <br />Report to make STUDY data and analyses available to the public as promptly as possible. The <br />STATE and the DWR reselVe the right to 81so publish the STUDY results. If the USGS has <br />already published the STUDY results, it shall, at the STATE'S or the DWR's request, furnish the <br />STATE or the DWR, at cost, with impressions suitable for reproduction purposes similar to that <br />for which the original copy was prepared. Any publication of STUDY results shall contain an <br />acknowledgment of the parties' participation in the STUDY. <br /> <br />8. Termination of agreement.
