Authority exists in the law, and funds have been budgeted, appropriated and otherwise <br />made available and a sufficient unencumbered balance thereof remains available for payment <br />in Fund Number 424, Organization YYYY, Appropriation V98, GBL USGS, Program WTRC, <br />Object Code 5120, Reporting Category ~Agreement Encumbrance Number 01 ,]1863. Ci5J2i-'Z3 <br /> <br />B. Required approval, clearance, and)c~o"7dnation have been accomplished from and with <br />appropriate agencies. <br /> <br />C. Section 37-60-121 (1)(b)(IV), C.R.S., authorizes the STATE to make grants from the CWCS <br />Construction Fund with specific authorization from the General Assembly. Section 37-60- <br />115(3), C.R.S. authorizes and directs theSrATE to study the state's ground water resource, <br />particularly nontributary water. <br /> <br />D, The USGS is participating in a geo-hydrologic investigation of the Denver Basin aquifers <br />("STUDY"), which will consist of drilling and coring a 2000 foot research well in the Denver <br />Basin aquifers near Kiowa in the central Denver Basin and conducting analyses, induding <br />geo-hydrologic analysis, of the core and core hole. The Denver Museum of Natural History <br />("MuSEUM") will coordinate the STUDY. Other participants in the STUDY include the Colorado <br />Division of Water Resources ("DWR"), and the National Science Foundation ("NSF"). The <br />USGS will store the core,. assist in hydrologic core analyses and aquifer testing, and publish a <br />report on the hydrologic aspects of the STUDY. <br /> <br />E. The MUSEUM applied to the STATE for a grant from the CWCB Construction Fund to <br />finance a portion of STUDY costs. At its January 1998 meeting, the CWCB approved a <br />Construction Fund grant in the amount of $90,000 to be used for participation in the STUDY <br />with the MUSEUM, the USGS and other water users, which grant would be used to match two <br />dollars for every one dollar contributed to the STUDY by any Colorado water user group or <br />agency. The CWCB conditioned disbursement of the grant funds on the MUSEUM'S receipt of <br />NSF funds. ' <br /> <br />F. Pursuant to H.B. 98-1189, Section 12. the General Assembly authorized the STATE to <br />allocate up to $90,000 to the MUSEU~I and to the USGS to conduc;:t the STUDY. <br /> <br />G.
