Re: Pro;ect Contract on Hourqlass Dam

To Whom It May Concern:

This letter is being written to serve as an attorney opinion
letter by the City Attorney for the city of Greeley. The Greeley
city Charter, section 3-5, states as follows:

The City may enter into agreements, contracts and
leases with governmental and private entities which
have been authorized by the City Council, or which are
consistent with the specific policy established by the
city Council. All written contracts, to which the city
is a party, shall be reviewed as to legal form by the
city Attorney, approved as to substance by the city
Manager, and as to availability of funds by the
Director of Finance. Contracts in writing binding the
city, and conveyances of interest in land by the city,
shall be signed by the Mayor and attested by the City
Clerk under the seal of the city, pursuant to authority
established by ordinance adopted by the city Council.

This section on the Charter requires the City to have the
signatures of the Mayor, the city Clerk attesting the Mayor's
signature, the City Manager as to substance, the city Attorney as
to legal form and the Director of Finance as to availability of
funds, to enter the Barnes Dam contract which is hereby attached.
