Scope. - Cooperat ive Agreements ulJde with State and local govern- <br />ments shall be in accordance with applicable provisions of the following: <br /> <br />a. Federal Management Circular (FMC) 74-4/0ffice of Management and <br />Budget (OMB) Circular A-llO, "Cost Principles Applicable to Grants and <br />Contracts with State and Local Governments. <br /> <br />b. FMC 74-7/0MB Circlllar A-102, "Uniform Administrative Require- <br />ments for Grants-in-Aid to State and Local Governments." <br /> <br />c. Intergovernment a 1 Cooperat ion Act qf 1968. <br /> <br />If the enabling legislation for a specific Federal assistance program <br />presribes pol ides or requirements that differ from the standards provided <br />therein,~the provisions of the enabling legislation shall govern. Except <br />where they are specifically excluded, the provisions of the above shall be <br />applied to subcontractors performing substantive work under the cooperative <br />agreement if such subcontractors are States or local governments. <br /> <br />2. Oefinitions: - For purposes of these provisions: <br /> <br />a. The term "cooperat ive agreement" means money or property in 1 ieu of <br />rooney, paid or furnished by the Federal Government to a State or local <br />government under programs thatprov ide f inanc i a 1 ass istance through <br />cooperative agreements. The term does not include technical assistance <br />programs which provide services instead of money or other assistance in <br />the form of general revenue sharing, loans, loan guarantees, insurance, <br />or contract s wh ich are entered into and admin istered under procurement <br />laws and regulations. <br /> <br />b. The term "State" means any of the several States of the United States, <br />the District of Columbia, the Commonwealth of Puerto Rico, any territory <br />or possession of the United States, or any agency or instrumentality of <br />a State exclusive of State institutions of higher education and hospitals. <br /> <br />c. The term "local government" means a local un it of government <br />including specifically a county, municipality, city, town, township, <br />local public authority, school district, special district, intrastate <br />district, council of governmer.ts, sponsor group represent at ive organiza- <br />tion (as defined in 7 CFR 620.2, 40 FR 12472, March 19, 1975), and other <br />regional or interstate government ent ity, or any agency or instrumental- <br />ityof a local government excluswe cf inst itut ions of higher educat ion <br />and~ hospitals. <br /> <br />3. Records Retention. -~ <br /> <br />a. Financial records, supporting documents, statistical records, <br />and all other records pert inent to il cooper at ive agreement <br />shall be retained for a period of 3 years, with the following <br />qualifications: <br /> <br />'.' <br />
