<br />WHEREAS, pursuant [o the provisions of sec[ion 37-60-119,
<br />Colocado Revised Statu[es, [he S[ate is authorized Co loan
<br />money for Che construction of water projects for t�e benefit of
<br />the people of the State; and
<br />WHERSAS, pursuant [o [he provisions of sec[ion 37-60-120,
<br />Colorado Revised S[atutes, the sta[e is authorized to take a
<br />security interest in proper[y or take such bonds, no[es, or
<br />other securi[ies evidencing an obliga[ion as will assuce
<br />repayment of funds�made available pursuant [o section
<br />37-60-119, Colocado Revised S[atutes; and
<br />WHEREAS, the Contractor is a duly constituted water
<br />conservancy district in the Sta[e of Colorado and wishes to
<br />cons[cuct, or cause to be constructed, the Stagecoac❑ Dam and
<br />Reservoir and associated si[e developments.� hereinafter called
<br />the projec[, at an estimated cos[ of Six[een Million One
<br />Hundred Thicty-Seven Thousand Dollacs ($16,137.000); and
<br />� . WHEREAS, a feasibility inves[igation of said project was
<br />\ conducted and it was found that the project is [echnically and
<br />� financially feasible; and
<br />i
<br />WHEREAS, sec[ion 1(1)(a) of c�apter 905, Session Laws of
<br />Colotado 1983, authorized Che Colorado Wa[er Conse[va[ion
<br />Board, subject to the conditions set forth in section 1(1)(d)
<br />of the said act, to construc[ or cause to be constructed Che
<br />said project at a Board cost of Six Million Dollars
<br />($6,000,000); and
<br />WHBREAS, section 1(1)(b) of the said act provides tha[ Che
<br />Colorado Wa[er Conservation Board may expend on the project [he
<br />said amount of money plus or minus such amoun[s as may be
<br />jus[ified by reason of ordinary fluc[uations in cons[ruc[ion
<br />costs as indicated by the engineering cos[ indices applicable
<br />to [he [ype of cons[ruc[ion involved in Che project; and
<br />WHEREAS, the State has determined that Che Six Million
<br />Dollars (E6,000,000) can be increased, due Co ordina�y
<br />fluctuations in cons[ruction costs as indicated by the
<br />enginee�ing cos[ indices applicable to Chis type oE
<br />cons[cuction, by Six Hundred Thousand Dollars ($600,000); and
<br />WHEREAS, [he condi[ions of subparagraphs (I). (II), and
<br />(III) oE sec[ion 1(1)(d) of chapter 905, Session Laws of
<br />Colorado 1983, have been met; and
<br />WHEREAS, [he si[e developmen[ plan required by subpara9raph
<br />(IV) oE section 1(1)(d) of Che said act was approved by [he
<br />Colocado General Assembly in sec[ion 11(1) of c�apter 259,
<br />Session Laws of Colocado 1989: and
