District whose property is located within the boundaries of the
District but outside the corporate boundaries of the Town as of
the date of this Agreement will pay for water service received
from the Town at the Town's out-of-Town water rate. CUstomers of
the District whose property is hereafter annexed to the Town will
pay in-Town water rates from and after the effective date of such
annexation. The out-of-Town water rate charged to customers whose
property is located within the boundaries of the District as of
the date of this Agreement will never exceed one and one-half
(1.5) times the in-Town water rate.

6.2 Determination of Sinale Familv Eauivalent~--Water Fees.
The Town and the District acknowledge that the Town's base water
fees are currently calculated on the basis of the number of Single
Family Equivalents (SFEs) assigned to the property receiving such
water service as currently set forth in Section 12-2-21-4 of the
Breckenridoe ~~. For a period of five (5) years following
the effective date of the dissolution of the District the Town
will calculate the base water fee for properties located within
the boundaries of the former'nistrict by using the number of SFEs
assigned to such properties by the District as of the date of this
Agreement. Following such five (5) year period, the number of
SEEs assigned to properties located within the boundaries of the
former District will be determined by applicable Town Ordinances
in effect from time to time.

7. Tan Fees.

7.1 Pavrnent of Town Plant Investment. Fees. Following
dissolution of the District, a customer whose property is located
within both 'the boundaries of the former District and the
corporate boundaries of the Town as of the date of connection to
the Town's municipal water system will pay to the Town a tap fee
to connect to the Town's municipal water system (called "Plant
Investment ,Fee" under Town Ordinances) at the Town's in-Town rate
as determined by applicable Town Ordinances in effect on the date
such connection is made. For a period of five (5) years from and
after the effective date of the dissolution of the District, a
customer tapping into the system or expanding an existing use
whose property is located within the boundaries of the former
District but outside the corporate boundaries of the Town as of
the date of connection to the Town's municipal water system will
pay to the Town Plant Investment Fees of Three Thousand Dollars
($3, ODD. DO) per SFE for new construction, such rate being the
District's tap fee rate which was in effect at the time of
dissolution. Following such five (5) year period, any such
customer tapping or expanding a use will pay to the Town a Plant
Investment Fee to connect to the Town's municipal water system at
the Town's out-of-Town rate. The out-of-Town Plant Investment Fee
