C. Ioannides, regarding the proposed <br />contract between the City of Loveland and the Board. <br /> <br />These assurances are as follows: <br /> <br />1. It is my opinion that the mayor of Loveland, who has <br />signed for the City of Loveland, is a duly elected official. <br /> <br />2. It is my opinion that the mayor has the authority to <br />bind the entity and that the contract has been validly approved by <br />the Loveland City Council. A copy of the minutes of the meeting <br />at which the contract was approved are attached. <br /> <br />3. It is my opinion that the Loveland City Council has the <br />authority to enter into this contract without a vote of the <br />residents of Loveland, as this contract comes within the "water <br />supply exception" of the Colorado Constitution, Article XI, <br />Section 6 (not Section 1 as referred to in the letter of April 3, <br />1987). <br /> <br />4. <br />Loveland <br />prevents <br /> <br />It is my opinion that there are no prOV1Slons in the <br />Municipal Code or any other state or local law that <br />this contract from binding the City of Loveland. <br /> <br />5.
