hereunder and before the commencement of the delivery of water ser-

vice hereunder, FLORENCE in consultation wi tl1 the Engineer and vii th

the approval of COAL CREEK and WILLIAI1SBURG shall establish a pro-

posed budget for water treatment and transmission for the succeeding

twelve months; the monthly portion of such budqet, to \oJit, one-

twelfth (1/12) of the annual cost, shall be allocated between the

Parties according to the amount of water used by each of the Parties

in relation to the total amount.of water delivered by the facilities

during that month.

COAL CREEK and WILLIAllSBURG shall pay to FLORENCE not later

than the tenth

(lOth) day of each month their proportionate

share of the transmission and treatment cost for the preceding month.

The budget for treatment and transmission shall be reviewed

and adjusted as necessary annually by the Parties; in addition, in

the event of a request by a~y of the.parties the treatment and trans-

mission bUdget shall be reviewed and adjusted as necessary at any time.

11. The cost of repairs to the facilities to be constructed

pursuant hereto including FLORENCE'S improved treatment plant, and the

replacement of necessary capital items shall be shared by all Parties

on a pe:r tap basis; that is, each Party shall pay the percentage of the

cost of a repair or replacement which the number of its taps bears to

the total number of taps receiving treated water from the facilities

constructed pursuant hereto.

12. Each of the Parties shall establish and as necessary

from time to time modify the rates and charges charged by it for

water service, sufficient to make the payments required of it by

paragraphs nine, ten and eleven above.

13. COAL CREEK and WILLIAl!SBURG shall promptly make all

payments to FLORENCE required by the terms hereof, ?ut the due date

of such payments shall be postponed ~f necessary to allow COAL CREEK

and WILLIAl-1SBURG no J.ess than seven (7) days after the receipt of

written notice from FLORENCE of the amount due, to make said payments.

14. This Agreement is subject to and contingent upon

FLORENCE receiving the loan and graI).t from Farmers Home referred to

in paragraphs H and I above.
