7. FL0~~NCE shall have legal titl8 co and shall operate, maintain and repair the facilities constructed by it pursuant to this Agreement. 8. FLORENCE shall pay all costs incurred in the construction of the water facilities referred to in paragraph six hereof, and shall pay the indebtedness incurred by it in accordance with the terms of any instruments of obligation entered into by FLORENCE to procure the finan- cing of such facilities. 9. Upon construction of the facil.i. i:ies hereunder, and prior to the conunencement of the delivery of water service hereunder, FLORENCE in consultation with the Engineer and with the approval of COAL CREEK and lvILLIAMSBURG shall establish a DEBT RETIREMENT TAP FACTOR, which shall be that amount of money necessary to pay annual principal and interest and reserve fund charges (required by the in- struments of obligation referred to in paragraph eight above) divided by 12 divided by the number of taps to be served by the facilities. The DEBT RETlRE~ffiNT TAP FACTOR shall be reviewed every twelve months thereafter to reflect any changes in principal, interest or reserve fund requirements or the number of taps to be served. COAL CREEK and WILLIAMSBURG shall advise FLORENCE within thirty (30) days of the hook-up of any additional taps added to their systems to be served by the facilities. COAL CREEK and WILLIAMSBURG shall pay to FLORENCE no later than the tenth (10th) day of each month a sum of money equal to the DEBT RETIREMENT TAP FACTOR, multiplied by the number of taps which re- ceived water in COAL CP~EK and WILLIAMSBURG, respectively, in the preceding month. 10. In addition to the payments referred to in paragraph nine above, each of the Parties shall pay its proportionate share of the actual pumping cost of transporting water from the point of diversion to the treatment plant, the cost of treatment, and the pumping cost of transporting \"'ater from the treabnent plant to the master meters, as provided herein.
