<br />7. FL0~~NCE shall have legal titl8 co and shall operate, <br /> <br /> <br />maintain and repair the facilities constructed by it pursuant to this <br /> <br /> <br />Agreement. <br /> <br />8. FLORENCE shall pay all costs incurred in the construction <br />of the water facilities referred to in paragraph six hereof, and shall <br />pay the indebtedness incurred by it in accordance with the terms of any <br />instruments of obligation entered into by FLORENCE to procure the finan- <br />cing of such facilities. <br />9. Upon construction of the facil.i. i:ies hereunder, and <br />prior to the conunencement of the delivery of water service hereunder, <br />FLORENCE in consultation with the Engineer and with the approval of <br />COAL CREEK and lvILLIAMSBURG shall establish a DEBT RETIREMENT TAP <br />FACTOR, which shall be that amount of money necessary to pay annual <br />principal and interest and reserve fund charges (required by the in- <br />struments of obligation referred to in paragraph eight above) divided <br />by 12 divided by the number of taps to be served by the facilities. <br />The DEBT RETlRE~ffiNT TAP FACTOR shall be reviewed every twelve months <br />thereafter to reflect any changes in principal, interest or reserve <br />fund requirements or the number of taps to be served. <br />COAL CREEK and WILLIAMSBURG shall advise FLORENCE within <br />thirty (30) days of the hook-up of any additional taps added to their <br />systems to be served by the facilities. <br />COAL CREEK and WILLIAMSBURG shall pay to FLORENCE no later <br />than the tenth (10th) day of each month a sum of money equal to the <br />DEBT RETIREMENT TAP FACTOR, multiplied by the number of taps which re- <br />ceived water in COAL CP~EK and WILLIAMSBURG, respectively, in the <br />preceding month. <br />10. In addition to the payments referred to in paragraph <br />nine above, each of the Parties shall pay its proportionate share <br />of the actual pumping cost of transporting water from the point of <br />diversion to the treatment plant, the cost of treatment, and the <br />pumping cost of transporting \"'ater from the treabnent plant to the <br />master meters, as provided herein. The cost of transporting the \vater <br />shall be the energy cost for pumping; the cost .of treatment shall in- <br />clude the cost of chemicals; supplies; utilities not associated with <br />water transmission; premiums for general liability, products liability, <br />and extended coverage insurance indluding fire, hail malicious mischief <br />and vandalism; premiums ro.r .flood in3ur:d{\Ce Eo= ':lny '\ i.'Jer.:::ion '..fOt":c::; L:l <br /> <br />- 5 - <br />
