ANNEXOR shall dedicate all necessary rights-of-way for the full width thereof of public <br />streets and interchanges and design and fully improve to TOWN standards within the <br />property without cost to the TOWN. <br /> <br />B. ANNEXOR shall pay for installation of traffic control devices for all perimeter streets <br />and streets within the property. <br /> <br />III. WATER AND SEWER <br /> <br />A. ANNEXOR agrees to install water distribution and sewer collection lines within the <br />Subject Property in accordance with the TOWN and Fremont Sanitation District <br />standards and specifications and pursuant to plans approved by the TOWN and Fremont <br />Sanitation District. <br /> <br />B. ANNEXOR agrees to install water transmission lines and sewer interceptor lines to the <br />property. <br /> <br />C. ANNEXOR agrees to dedicate all necessary unobstructed right-of-way for utility <br />easements needed for water and sewer lines to serve the area described herein. <br /> <br />D. ANNEXOR agrees to develop and provide to the TOWN for review and approval prior to <br />platting of the property a master utilities plan for the annexed area. The master utilities <br />plan shall describe transmission facilities and, to the extent possible, distribution <br />facilities. <br /> <br />E. The parties mutually agree that ANNEXOR shall design and install water lines and fire <br />hydrants within the lands described herein in accordance with TOWN standards and <br />specifications, subject to approval of the TOWN CounciL <br /> <br />F. ANNEXOR agrees to provide the TOWN with one Union Ditch water share for every <br />ERU (Equivalent Residential Unit as defined in Resolution No.9-Series 2002) proposed <br />unless otherwise approved by the TOWN CounciL The common area/clubhouse ERUs <br />will be determined by a water usage analysis. <br /> <br />G. ANNEXOR agrees that all Union Ditch shares will be converted from Agricultural use to <br />municipal use before any building permits are issued. In the event that water court case <br />99CWl49 does not automatically change the newly acquired Union Ditch shares <br />furnished by the ANNEXOR to municipal use, ANNEXOR agrees to pay all attorney <br />fees to transfer the said water shares in water court. <br /> <br />IV. STORM DRAINAGE <br /> <br />ANNEXOR agrees to submit an analysis of the existing and future drainage of any property to be <br />subdivided. The analysis shall be prepared by a Professional Engineer licensed in the State of <br />Colorado. <br /> <br />2 <br />
