<br />~ <br /> <br />PRE-ANNEXATION AGREEMENT FOR PROPERTY COMMONLY KNOWN <br />AS COAL CREEK RANCH <br /> <br />THIS PRE-ANNEXATION AGREEMENT is entered into by and between Brian <br />Sullivan and Deborah Riekeman Raisner, hereinafter referred to as "ANNEXOR," and the <br />TOWN OF COAL CREEK, a municipal corporation of the County of Fremont, State of <br />Colorado, hereinafter referred to as "TOWN." <br /> <br />WITNESSETH <br /> <br />WHEREAS, ANNEXOR is the record owner of property legally described in Exhibit "A" <br />attached hereto and incorporated herein (hereinafter referred to as the "Subject Property"; and <br /> <br />WHEREAS, the Subject Property is adjacent to and contiguous to the existing corporate <br />boundary of the TOWN but is not situated within the limits of any municipality; and <br /> <br />WHEREAS, ANNEXOR desires to have the Subject Property annexed to the TOWN and desires <br />to have the Subject Property zoned as MH-II (Mobile Home II District) which would permit the <br />Subject Property to be used for residential purposes and other purposes as set forth herein; and <br /> <br />WHEREAS, the Subject Property is approximately 131.6 acres, and no electors reside thereon; <br />and <br /> <br />WHEREAS, the parties mutually agree that the annexation of the Subject Property to the TOWN <br />shall not create any additional cost or impose additional burden on the existing residents of the <br />TOWN to provide public facilities and services to the property after annexation; and <br /> <br />NOW, THEREFORE, in consideration of the above-representations and the covenants, <br />conditions, and agreements set forth herein, the TOWN and ANNEXOR agree as follows: <br /> <br />I. DEFINITIONS <br /> <br />"ANNEXOR" shall mean and refer to the ANNEXOR, and his heirs, successors, assigns, and <br />designees. <br /> <br />"Streets" shall mean and refer to residential, commercial, collector, minor and principal arterial <br />streets, highways, expressways, and roadways. <br /> <br />"Water Transmission lines" shall mean and refer to water lines installed according to the <br />TOWN's standards and specifications. <br /> <br />II.
