(Decretal i10.) <br /> <br />(f) Applicants may divert water from the Arkansas River under <br />their direct flow water right which is the subject of <br />Case BOCW9l in this Court, at,a rate of flow 4.0 times <br />the amount of augmentation water available for said <br />purpose under paragraph 10 hereof. (Decretal i11_) <br /> <br />(g) Applicants may divert water from the Arkansas River under <br />their storage water right which is the subject of <br />Case BOCW92 in this Court, at a rate, of flow equal to the <br />amount of augmentation water available for said purpose <br />under paragraph 10 hereof. (Decretal ~12.), <br /> <br />(hI Applicants may store, in the said Oak Creek Reservoir, <br />water diverted under their ownership of the shares of <br />Union Ditch mentioned in foregoing paragraph 2, including <br />Rainbow Park shares. However, the water 50 stored will <br />suffer a substantial evaporative 1055. Therefore, only <br />half of such water conveyed' to said reservoir may be <br />stored therein, the other half to be immediately released <br />to the stream system via the outlet works of said <br />reservoir. (Decretal 113.) <br /> <br />Sewaae Treatment. substantially all wastewater from Applicant <br />municipalities is treated by the plant ,of the Fremont County <br />Sanitation District, which discharges treated waste water into <br />tlie Arkansas River in the SE 1/4, Sec. 14, T19S, R69W, <br />pursuant to an NPDES permit. The Town of Williamsburg uses <br />individual septic systems in the drainage area of Oak Creek. <br />The Town of .Coa1 Creek uses' individual septic systems in the <br />drainage of Coal Creek. <br /> <br />Proposed Provisions under ~ 37-92-304 (3.51. The changes <br />pursuant t080CW93 caused no substantiated complaints as to <br />injurious "shrink" (seepage and evaporation) in the Union <br />Ditch and Rainbow systems. Applicants propose to install up <br />to a total of three measurement devices, in addition to those <br />already in use, on a when and as needed basis, to determine <br />whether structural improvements are needed to avoid an <br />increase in the share of shrink borne by other shareholders in <br />those companies as a result of the proposals herein. <br />Applicants disclaim any .responsibility for shrink caused by <br />changes in irrigation practices or use of water as a result of <br />actions of other shareholders_ <br /> <br />5 <br />
