<br />In summary, the Town of Coal Creek needs to acquire additional water rights to replace <br />depletions caused by its out-of-priority diversions, <br /> <br />Alternatives Evaluated <br /> <br />A range of alternatives were considered including I) No action, 2) Purchase sufficient <br />Union Ditch and Fremont County Ditch shares to satisfy the Town's existing water need <br />of34 acre-feet consumptive use, and 3) Purchase sufficient Union Ditch shares to satisfy <br />the Town's existing water need of34 acre-feet consumptive use, <br /> <br />A subjective evaluation of the alternatives follows: <br /> <br />l. No action, <br /> <br />This alternative is feasible. However, it carries a risk ofthe Town of Coal Creek being <br />unable to provide sufficient water in the summer for existing use conditions, It also <br />means the Town's water rights will be out of priority during dry years, most likely <br />including the present year, There also is the cost associated with acquiring water rights in <br />the future at much higher cost. <br /> <br />2, Purchase sufficient Union Ditch and Fremont County Ditch shares to satisfY the <br />Town's existing water need of 34 acre-feet consumptive use, <br /> <br />This alternative is not the preferred alternative because the consumptive use per share <br />from the Fremont County Ditch has not been established in water court, It could take up <br />to 10 years to obtain such a ruling, with uncertain outcome, <br /> <br />3, Purchase sufficient Union Ditch shares to satisfY the Town's existing water need of 34 <br />acre-feet consumptive use, <br /> <br />This is the preferred alternative since the Union shares have been transferred to municipal <br />use in the past. Each share produces approximately 1.25 acre-feet, of which 27% is <br />allowable consumptive use, <br /> <br />The Selected Project <br /> <br />The selection of Alternative 3 involves purchase of approximately 100 shares of the <br />Union Ditch, and providing those shares to the City of Florence for treatment, 100 <br />shares equates to approximately 125 acre-feet, of which 27%, or 34 acre-feet is allowable <br />consumptive use.
