The Town of New Castle, through a long-tenn contract from the United States <br />Department of Interior, Bureau of Reclamation, for the release of water from <br />Ruedi Reservoir or other substitute storage facilities in the amount of 100 acre- <br />feet per year, will provide augmentation water to replace otherwise out-of-priority <br />depletions under the New Castle Augmentation Station. The New Castle <br />Augmentation Station will be used to divert water, from the Colorado River to a <br />point in Elk Creek above the Ware and Hinds Ditch or in the Ware and Hinds <br />Ditch to provide a substitute supply of water to the Ware and Hinds Ditch at such <br />times as the Red Rock Ditch is out of priority and used for augmentation under <br />this application. At such times as the New Castle Augmentation Station water <br />right is diverting water out of priority and subject to the exercise of a valid call <br />located on the Colorado River, augmentation of depletions thereunder shall be <br />made by releases of water from Ruedi ReservQir pursuant to the contract between <br />the Town of New Castle and the United States Department of Interior, Bureau of <br />Reclamation. Depletions under the New Castle Augmentation Station delivered <br />to the Ware and Hinds Ditch for irrigation purposes shall be deemed to be equal <br />to depletions associated with municipal diversions by the Town of New Castle in <br />the same amount. Such depletions, which represent the consumptive use of water <br />within the development, shall be the following percentages of said municipal <br />diversions: <br /> <br />May <br />June <br />July <br />August <br />September <br />October <br /> <br />36 percent <br />40 percent <br />42 percent <br />38 percent <br />34 percent '~ <br />27 percent <br /> <br />(These numbers are subject to <br />change based on changes made <br />pursuant to Paragraph 7.F., above.) <br /> <br />At such time as the water right decreed to the New Castle Augmentation Station <br />is out of priority, the Applicant shall cause to be released under its above- <br />referenced contract water from Ruedi Reservoir in an amount equal to the <br />calculated depletion, plus a transit or stream -carriage loss equal to the constant <br />rate of 9.5 percent for the first 14 days of release after the first water is released <br />under said contract (irrespective of whether said 14 days occur consecutively) and <br />0.4 percent for each day thereafter through termination of the augmentation <br /> <br />C:\F1U:S\NEWCAST.l DE <br />July 17. 1991 <br /> <br />-16- <br />
