The Town of New Castle <br />, will thereby provide a substitute supply to the Ware and Hinds Ditch in an amount equal to the <br />lesser of the, amount validly called by said ditch or the upstream diversions not augmented by <br />in-priority water rights under the plan for augmentation. The date of appropriation for the <br />exchange is May 22, 1984. The amount of water the Town shall be allowed to exchange from <br />the Buster Pump and Pipeline and Adam's Lake is limited to the following: <br /> <br />A. 460 acre-feet per year, except that the portion divertible under the Buster Pump <br />and Pipeline decree shall be available only from May to October of each year. <br /> <br />B. The amount exchanged must be available in priority at the original point of <br />diversion for Adam's Lake and/or Buster Pump and Pipeline. <br /> <br />C. The Applicant shall be responsible to ensure that such amounts are available at <br />the original point of diversion. <br /> <br />PLAN FOR AUGMENTATION <br />(New Castle Augmentation Station) <br /> <br />11. The Court finds with respect to the plan for augmentation for the New Castle <br />Augmentation Station point of diversion: <br /> <br />A. Names of structure to be augmented: New Castle_Augmentation Station described <br />in Paragraph 8, above. ' <br /> <br />B.
