The application filed herein consists of five separate but interrelated parts which <br />together comprise a system to provide a legal water supply by the Town of New Castle through <br />its New Castle Water Works System and Pipeline to a proposed development annexed to said <br />Town and owned by Eric C. Williams. In summary, the components are as follows: <br /> <br />A. An application for water rights for the New Castle Augmentation Station, which <br />is designed to divert water from the Colorado River for delivery to Elk Creek for <br />exchange purposes. <br /> <br />B. A plan for augmentation to allow for diversions through the ~ew Castle Water <br />Works System and Pipeline. <br /> <br />C. An application for change of w~ter rights for the Buster pump and Pipeline and <br />Adam's Lake to allow those rights to be used through the New Castle <br />Augmentation Station. <br /> <br />D. An application for approval of exchange to allow substitute water to be provided <br />to calling water rights on Elk Creek through the New Castle Augmentation ' <br />Station. <br /> <br />E. A plan for augmentation to allow for diversions through the New Castle <br />Augmentation Station. <br /> <br />PLAN FOR AUGMENTATION <br />(New Castle Water Works System and Pipeline) <br /> <br />4. The application filed herein includes an application for approval of a plan for <br />augmentation. Depletions resulting from otherwise out-of-priority diversions from the following <br />structure are to be augmented pursuant to the terms of this Decree: 'New Castle Water Works <br />System and Pipeline. The following water rights are. diverted from this structure: <br /> <br />A. New CaStle Water Works System and Pipeline adjudicated in Civil Action No. <br />1058 in the District Court in and for Garfield County on May 29, 1904, nunc pro <br />tunc September 6, 1889, as Domestic Priority No. 1 for 2.67 c.f.s. (plus an <br />additional 1.0 c.f.s. in case of emergency and fire protection purposes) from East <br />Elk Creek for municipal and other purposes, with an appropriation date of <br />September 6, 1889. <br /> <br />B. New Castle Water System First Enlargement adjudicated in Case No. 81CW477 <br />in the Districr-Court in and for Water Division No.5, State of Colorado, on <br />October 18, 1982, for 10.0 c.f.s. from East Elk Creek for municipal and other <br />purposes, with an appropriation date of December 23, 1981. <br /> <br />C:\FILES\NEWCAST.l DE <br />July 17, 1991 <br /> <br />-2- <br />
