It,appearing to the Referee from the files and records of said application that Statements <br />of Opposition had been filed, the Referee determined, as provided by C.R.S. ~37-92-303(1), not <br />to make a ruling, and on December 5, 1990, ordered that, in accordance with C.R.S. ~37-92- <br />303(2), the case be re-referred to the Water Judge of Water Division No. 5, State of Colorado. <br /> <br /> <br />This matter is now before the Court upon the Motion for Summary Judgment f1led by <br />the Applicant.
