Reservoirs constructed after 1929 are <br />subject to several substantial limitations on storage contained in <br />the Rio Grande Compact which often can limit their ability to store <br />water. <br /> <br />Not only do pre-compact reservoirs like Continental Dam make <br />water available for use in Colorado that might otherwise flow out <br />of the state unused, they also help the state Engineer to <br />administer water rights to ensure compliance with the compact. In <br />1987 the Company entered into an agreement with the state Engineer <br />formalizing an existing cooperative administrative practice <br />involving the three large pre-compact reservoirs on the Rio Grande. <br />Under that practice, the state is permitted to use the Company's <br />reservoirs to store water that would otherwise be delivered to New <br />Mexico for compact purposes. .This water is held in storage until <br />it is determined whether the water will be needed to satisfy <br />Colorado's compact obligations. If it is not needed, the water is <br />made available to water useJ:'S in the San Luis Valley. This <br />practice simplifies administration of water rights and maximizes <br />the amount of water available for beneficial use in Colorado. The <br />Company believes that these unique and irreplaceable benefits of <br />the pre-compact reservoirs to the State of Colorado more than <br />justify the modest grant it is seeking. <br /> <br />The Company will be happy to meet with you, any members of <br />your staff and any Board members to discuss the proposed <br />feasibility study and the Company's proposed cost sharing.
