<br />I <br /> <br />I <br /> <br />I <br /> <br />granted to a fire protection district in this article upon the filing <br />of a resolution to that effect in the district court having juris- <br />diction, if the fire protection district does not exist within the <br />boundaries of the water or sanitation district. A fire protection <br />district, upon approval at an election called for such purpose, may <br />consolidate with an existing water, sanitation, or metropolitan <br />district or may exercise the power or authority of a water or sani- <br />tation district if a water or sanitation district does not exist <br />within the boundaries of the fire protection district. Before con- <br />solidation with an existing district, all of the debts of the fire <br />protection district must be paid and a resolution to such effect <br />passed by the board and contained in the notice of election for the <br />purpose of consolidation, which notice shall be published. The elec- <br />tion shall be handled in the same manner as provided in part 8 of <br />article 1 of this title. Upon consolidation, all of the assets and <br />cash of the fire protection district shall become the property of the <br />district with which it was consolidated. Upon the transfer of said <br />assets and cash, the board of the fire protection district shall <br />cease to function and shall be no longer in existence. <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />32-3-116. Taxes Generally <br /> <br />I <br /> <br />In addition to the other means of providing revenue for such district, <br />the board has the power to levy and collect ad valorem taxes on or <br />against all taxable property within the district. <br /> <br />I <br /> <br />32-3-117. Levy and Collection <br /> <br />~ <br /> <br />(1) To levy and collect taxes, the board shall determine in each year <br />the amount of money necessary to be raised by taxation, taking into <br />consideration all sources of revenue of the district, and shall fix a <br />rate of levy which, when levied upon every dollar of the valuation for <br />assessment of the property within the district and together with other <br />revenues, will raise the amount required by the district annually to <br />supply funds for paying the expenses of the organization and the costs <br />of constructing, operating and maintaining the works and equipment of <br />the district, and will pay promptly in full, when due, all interest <br />on and principal of bonds and other obligations of the district. In <br />the event of accruing defaults and deficiencies, additional revenue may <br />be made as provided in Section 32-3-118. In the event, however, that <br />the board of a sewer, water, or metropolitan district divides that <br />district into areas according to the facilities and services furnished <br />or to be furnished therein, the board shall determine the amount of <br />money necessary to be raised by taxation within such area taking into <br />consideration other sources of revenue within the area and shall fix a <br />rate of revenue which, when levied upon every dollar of the valuation <br />for assessment of taxable property within such area of the district, <br />will supply funds for the payments of the costs of acquiring, opera- <br />ting, and maintaining the services or facilities furnished in such <br />area and will pay promptly, when due, the principal or interest on <br />bonds or other obligations issued and its pro rata share of the general <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />II - 4 <br />
